First Class Facility definition

First Class Facility means a facility that has been renovated from time to time to modern standards, to the extent necessary to attract a high percentage occupancy and generate high gross proceeds from the operation of the Airport;
First Class Facility. Standard shall mean a standard for the design and construction of the Coliseum Plaza Improvements which shall, following the procedure hereinafter set forth in Article 5 of this Lease, provide plans and specifications for the Coliseum Plaza Improvements that will result in the construction of a first class facility that is comparable to, but not identical to, the entertainment related components of the Ridge Hill Shopping Center in Yonkers, New York (or, in the case of a music venue, a newly constructed Fillmore or House of Blues theater), and will comply with Legal Requirements; provided, however, that it is understood and agreed that the Coliseum Plaza Improvements will not be exactly the same as the entertainment related components of the Ridge Hill Shopping Center in Yonkers, New York (or, in the case of a music venue, a newly constructed Fillmore or House of Blues theater), and will have, for example, different types and numbers of amenities, restaurants, vendors, size, levels, design, public spaces, and occupants (or, in the case of a music venue, different size, architectural details, seating capacities and/or configurations, food service options, and the like).
First Class Facility means a state-of-the-art Major League Baseball park that is capable of hosting events other than baseball, including concerts, family entertainment and meeting/special events, wherein the level and quality of: (a) the baseball park amenities (such as private suites, restaurants and concessions located in or around the Ballpark Property) are consistent with the level and quality of amenities in other Major League Baseball parks built or under construction within five years prior to the Effective Date to host Major League Baseball events, and (b) interior and exterior Ballpark Property finishes are comparable to the level and quality of interior and exterior finishes in Major League Baseball parks built within five years prior to the Effective Date to host Major League Baseball and other events.

First Class Facility. Requirement With Enormous Long-Term Obligations For Metro Problem- The Lease creates the 1996 Titans Lease problem all over again for Nashville. The Lease includes a Capital Repair process (See Section 5(f) of the Lease) centered around maintaining a “Facility Standard” that is equal toComparable Facilities.” The definition of “Comparable Facilities” is based on “first-class” venues, along with other factors, which effectively defines only other venues owned by Bristol’s own parent company, SMI. So SMI will essentially be able to define the Facility Standard for the new Fairgrounds speedway based on their own facilities. Finally, Section 20(c)(ii) of the Lease grants a potential termination right to Bristol due to: “the failure of the Fair Board to keep, observe or perform any of the material terms, covenants or agreements contained in this Lease on the Fair Board’s part to be kept, performed or observed by the Fair Board.” Effectively, these provisions will give Bristol enormous future negotiating leverage, exactly like the very same lawyers and lobbyists are currently using for their other client the Tennessee Titans to justify the new Titans stadium proposal. The future scenario for this new speedway would be far worse than the current “Titans/first-class stadium” requirement debate, since Bristol will be able to claim a termination right if the Fair Board does not agree with Bristol’s desired upgrades, and Bristol will be able to more readily threaten to relocate its races, such as to the speedway SMI owns in Wilson County. In short, Xxxxxx’s proposal is a modern day version of the much maligned 1996 Titans Lease, on steroids.
