Firm Service Toll definition

Firm Service Toll means the toll payable by a Term Shipper pursuant to its Contract, which is the sum of the Firm Service Fee plus the net toll applicable in accordance with the Toll Schedule.

  • This Agreement shall become effective on the date hereof and shall continue in full force and effect until the earlier of either: (i) the Commencement Date, provided that Sections 3.2 , 5.6 and 12.2 and Article 6 shall continue until any Firm Service Toll adjustment and audit are completed; or (ii) this Agreement is terminated pursuant to Articles 5 or 7.

  • If, during the term of this Agreement, the Carrier has in effect an Uncommitted Toll that is discounted to a rate lower than the Firm Service Toll for the same Service Option, the Firm Service Toll will be discounted by the same percentage for so long as the Uncommitted Toll is discounted (unless such lower toll is the result of a direction by the NEB not initiated by the Carrier).
