Final Payment Claim definition

Final Payment Claim means the Payment Claim made pursuant to clause 13.2 (Invoices and Payments) upon the issue of the Certificate of Final Completion.
Final Payment Claim means a payment claim given by the Developer to Council under clause 36.13.
Final Payment Claim means a payment claim lodged by the CIDS/ODS Contractor in accordance with clause 14.11.

  • Failure by the Contractor to provide with the Final Payment Claim such substantiation in respect of any event occurring before the Date of Practical Completion shall subject to Clause 23.5(2) and 23.6 bar the Contractor from advancing any claim for such an amount.

  • Insofar as substantiation of any claim has not been provided pursuant to Clause 23.3 or 23.4, the Contractor shall provide such substantiation with such a Final Payment Claim.

  • Within 14 days of receipt of a Final Payment Claim, the Principal shall issue to the Contractor a certificate certifying the amount which, in the Principal’s reasonable opinion is finally due from the Principal to the Contractor, or from the Contractor to the Principal arising out of this Contract ( Final Certificate).

  • Where the Principal fails to issue a Final Certificate, any claim for payment by the Contractor pursuant to the Final Payment Claim is deemed to be rejected.

  • The Final Payment Claim must include any Claim not previously included in a Payment Claim.

  • If the Principal disputes that the Consultant is entitled to the amount claimed in the Final Payment Claim, the Principal will prior to the time for payment required under the Contract, advise the Consultant of the undisputed amount.

  • The provisions relating to Interim Payments in Clause 11(b) in respect of deductions and Clause 11(c) in respect of payment also apply to the payment following the Final Payment Claim.


More Definitions of Final Payment Claim

Final Payment Claim means the final payment claim referred to in clause 57.11.

  • Contingent Claim means any Claim, the liability for which attaches or is dependent upon the occurrence or happening of, or is triggered by, an event, which event has not yet occurred, happened or been triggered as of the date on which such Claim is sought to be estimated or an objection to such Claim is filed, whether or not such event is within the actual or presumed contemplation of the holder of such Claim and whether or not a relationship between the holder of such Claim and FairPoint now or hereafter exists or previously existed.

  • Earn-Out Payment has the meaning set forth in Section 2.5(a).

  • Settlement Payment means the transfer, or contractual undertaking (including by automated clearing house transaction) to effect a transfer, of cash or other property to effect a Settlement.

  • Closing Date Payment has the meaning set forth in Section 2.04(a)(i).

  • Closing Payment Amount will have the meaning set forth in Section 1.3(a).

  • Additional Payment is as defined in Section 6 of the Agreement.

  • Damage Payment means the dollar amount equal to the amount to be posted as Project Development Security pursuant to Section 8.4(a)(i) hereof.

  • Earnout Payments has the meaning set forth in Section 2.2(a).

  • Deficiency Payment has the meaning set forth in Section 9(a).

  • Indemnity Claim has the meaning set forth in Section 8.3.

  • Deficiency Claim Amount has the meaning set forth in Section 5.5(a).

  • Interim Payment has the meaning specified in Section 10.1.

  • Annual Payment The total amount payable to the Settlement Fund Administrator by the Settling Distributors on the Payment Date each year, as calculated by the Settlement Fund Administrator pursuant to Section IV.B.1.e. For the avoidance of doubt, this term does not include the Additional Restitution Amount or amounts paid pursuant to Section X.

  • Indemnity Payment shall have the meaning set forth in Section 4.4(a).
