Fifth Floor Premises definition

Fifth Floor Premises means the premises known as the 5xx Xxxxx, 0 Xxxxxxxx Xxxxxx and more particularly described in the Fifth Floor Lease shown for the purposes of identification only edged in red on the relevant Floor Plans;
Fifth Floor Premises means the Seller's place of business located at 000 Xxxx 00xx Xxxxxx, 0xx Xxxxx, Xxx Xxxx, Xxx Xxxx 00000.
Fifth Floor Premises has the meaning given to it in the Lease;

Examples of Fifth Floor Premises in a sentence

  • If the Landlord’s Fifth Floor Premises Construction Estimate states that the Tenant Improvements will be completed later than January 15, 2011 (the “Desired Fifth Floor Premises Completion Date”), then the parties agree to mutually cooperate to revise the scope of the Tenant Improvements set out in Tenant’s Fifth Floor Premises Plans so as to achieve the Desired Fifth Floor Premises Completion Date.

  • Landlord shall pay an allowance to Tenant in the amount of [***] (the “Fifth Floor Allowance”) towards the cost of performing the work (“Tenant’s Fifth Floor Work”) in the Fifth Floor Premises and, subject to Section 3(A) above, Tenant’s Fourth Amendment Work.

  • In connection with the foregoing, Landlord and Tenant agree that Landlord will construct the Tenant Improvements in the Fifth Floor Premises prior to the Fifth Floor Premises Delivery Date (hereinafter defined).

  • Notwithstanding the foregoing, Landlord will not be obligated to deliver possession of either the Fifth Floor Premises or the Sixth Floor Premises to Tenant until Landlord has received from Tenant a copy of this Lease fully executed by Tenant.

  • The “Fifth Floor Premises Delivery Date” shall be the earlier of: (i) the date that Landlord delivers possession of the Fifth Floor Premises to Tenant with Landlord’s Fifth Floor Work (as hereinafter defined) Substantially Complete and in the Delivery Condition, or (ii) the date on which Tenant occupies the Fifth Floor Premises for the conduct of its business.

  • The parties hereby confirm that (i) the Area A Delivery Date and Area B Delivery Date each occurred on March 24, 2019 and (ii) the Fifth Floor Premises Delivery Date occurred on April 1, 2019.

  • The warranty period shall be the longer of nine (9) Months after delivery of the Fifth Floor Premises or the Sixth Floor Premises, respectively, to Tenant, including any Early Occupancy under Section 4.4 below or such longer warranty period(s) as Landlord may have from any contractors or other third parties.

  • Except as set forth in this Section 5(A), Landlord shall not be liable for any failure to deliver the Fifth Floor Premises by any particular date, no such failure shall impair the validity of the Lease or extend the Term and there shall be no postponement of the Fifth Floor Premises Rent Commencement Date.

  • Commencing as of the Fifth Floor Premises Delivery Date, Tenant shall to pay for electricity and overtime HVAC charges with respect to the Fifth Floor Expansion Premises in accordance with Section 16 of this Fourth Amendment, and Section 5.2 of the Lease shall not apply to the Fifth Floor Premises.

  • The foregoing shall not limit Landlord’s repair, maintenance, restoration and remediation obligations under the Lease with respect to the Fifth Floor Premises and Landlord’s obligation to pay the Fourth Amendment Allowances (as hereinafter defined) under this Fourth Amendment.

  • Expansion Space means any space in the Building which, at any time during the Lease Term, is occupied by a Person other than Landlord under a written lease with Landlord, and the term “Tenant’s Expansion Space” means Expansion Space which Tenant has elected to lease as provided in this paragraph. Landlord agrees to notify Tenant promptly after Landlord learns that any Expansion Space is or will become available. Subject to the prior rights of other tenants to whom Landlord has granted substantially similar rights, Tenant has the option to lease any Expansion Space which Landlord notifies Tenant is or will become available. If Tenant gives Landlord notice of its exercise of this option within thirty (30) days after notification from Landlord of the availability of the Expansion Space and if no Event of Default exists when Tenant’s notice is given, this Lease will be deemed to be amended to include Tenant’s Expansion Space as part of the Premises for the remainder of the Lease Term upon all of the same terms contained in this Lease except that (i) the Rentable Area of the Premises will be amended to include Tenant’s Expansion Space; (ii) Tenant’s Share will be increased to include the rentable area of Tenant’s Expansion Space; (iii) the Term Commencement Date with respect to Tenant’s Expansion Space will be the earlier of sixty (60) days after the date on which Tenant’s Expansion Space becomes vacant and ready for occupancy (provided that date is at least sixty (60) days after Tenant exercises its option to lease the Expansion Space), or the date on which the Expansion Space is first occupied by Tenant; (iv) if Tenant’s Expansion Space contains a rentable area of 10,000 square feet or more, and if there are less than three (3) Lease Years remaining in the Lease Term, the Lease Term will be extended to include three (3) full years from the Term Commencement Date with respect to Tenant’s Expansion Space; and (v) subject to adjustment during each Fixed Rental Period as provided in Exhibit E, Basic Rent for each year of the remaining Lease Term (as it may be extended) will be the greater of (a) the Basic Rent last paid by the Person most recently occupying Tenant’s Expansion Space or (b) Market Rent determined as provided in the Rent Rider attached as Exhibit E. If Tenant exercises this option, Tenant’s Expansion Space will be leased to Tenant in its “as is” condition and Tenant will, at its expense and in compliance with the provisions of Section 7.06, design and construct all Improvements desired by Tenant for its use and occupancy. Landlord and Tenant agree to execute such amendments to this Lease and other instruments as either of them considers necessary or desirable to reflect Tenant’s exercise of this option.

  • residential premises means a house, building, structure, shelter, or mobile home, or portion thereof, used as a dwelling, home, residence, or living place by 1 or more human beings. “Residential premises” includes an apartment unit, a boardinghouse, a rooming house, a mobile home, a mobile home space, and a single or multiple family dwelling, but does not include a hotel, a motel, motor home, or other tourist accommodation, when used as a temporary accommodation for guests or tourists, or premises used as the principal place of residence of the owner and rented occasionally during temporary absences including vacation or sabbatical leave.

  • Office Premises means any building, facility, or portion thereof, or other premises, whether owned or controlled by CP, which is used solely for clerical or administrative purposes and which does not contain heavy equipment or machinery, as designated by CP from time to time;

  • Banking Premises means the interior of that portion of any building occupied by a banking institution or similar safe depository.

  • Off-premises sign means a sign directing attention to a use, product, commodity or service not related to the premises upon which the sign is located.

If a sign consists principally of brand name or trade name advertising and the product or service advertised is only incidental to the principal activity conducted or maintained on the property, or if the sign brings rental income to the property owner or sign owner, it shall be considered the business of outdoor advertising and not an on-premises sign. On-premises sign does not include a sign on a narrow strip of land contiguous to the advertised activity, or a sign on an easement on adjacent property, when the purpose is clearly to circumvent the intent of this act.

  • Commercial Premises Means a place of trade or premises operated for financial gain, including but not limited to, a retirement village or a block of flats that has a common facility; a place of trade where the manufacture and production of products or produce takes place; a site where renovation, restoration and refurbishment work as described in Appendix B takes place.

  • School premises means either of the following:

  • Storage Space means a space where goods of non-hazardous nature are stored and includes cold storage and banking safe vaults;

  • Rentable Area of the Premises The amount of square footage set forth in Section 1.01(10).

  • Subleased Premises means such portions of the Leased Premises being particularly identified on Schedule B, which the parties agree, for the purposes of this Sublease and any square footage calculations pursuant hereto, is approximately 42,244 square feet of office (21,068 square feet on the third floor and 21,176 square feet on the seventh floor) and approximately 9.4312% of common space (building rentable area is 447,917 square feet).

  • industrial premises means any place or premises (not being a private dwelling house), including the precincts thereof, in which or in any part of which any industry, trade, business, occupation or manufacturing is being ordinarily carried on with or without the aid of power and includes a godown attached thereto;

  • Building Square Footage or "BSF" means the square footage of assessable internal living space of a Unit, exclusive of any carports, walkways, garages, overhangs, patios, enclosed patios, detached accessory structure, other structures not used as living space, or any other square footage excluded under Government Code Section 65995 as determined by reference to the Building Permit for such Unit.

  • Collocation Space means an area of space located in a Building to be used by CLEC to house telecommunications equipment. Additionally, roof or wall space used for wireless interconnection shall be included in the definition where applicable.

  • Work space means that portion of the court’s facilities dedicated to each court reporter, including but not limited to actual space in the courtroom and any designated office space.

  • Grave space means a space of ground in a cemetery that is used or intended to be used for an in-ground burial.

  • Rentable Area when applied to the Premises, is that area equal to the usable area of the Premises, plus an equitable allocation of Rentable Area within the Building that is not then utilized or expected to be utilized as usable area, including that portion of the Building devoted to corridors, equipment rooms, restrooms, elevator lobby, atrium and mailroom.

  • New Building ’ means a new construction to house a complete motor vehicle as- sembly process, where that construction includes the pouring or construction of a new foundation and floor, the erection of a new frame and roof, and the instal- lation of new plumbing and electrical and other utilities;

  • Residence premises means the unit where you reside shown as the "residence premises" in the Declarations.

  • Leased space means individual storage space at a self-service storage facility which is rented to an occupant pursuant to a rental agreement.
