Fiduciary definition

Fiduciary has the meaning set forth in ERISA Sec. 3(21).
Fiduciary means any person who (a) exercises any discretionary authority or discretionary control respecting management of the Plan or exercises any authority or control respecting management or disposition of its assets, (b) renders investment advice for a fee or other compensation, direct or indirect, with respect to any monies or other property of the Plan or has any authority or responsibility to do so, or (c) has any discretionary authority or discretionary responsibility in the administration of the Plan.
Fiduciary has the meaning set forth in ERISA Section 3(21).

Examples of Fiduciary in a sentence

  • Fiduciary will direct the transfer of Participating Trust assets to the Trustee for investment in the Funds from time to time in accordance with the Declaration of Trust, Schedule A Document and any applicable procedures for additions to such Fund that the Trustee may adopt from time to time; and Xxxxxxxxx agrees that each warranty, representation, acknowledgement and covenant made by it in this Agreement will be deemed to be repeated as of the date of any such addition.
