FERC Certificate definition

FERC Certificate means the certificate(s) of public convenience and necessity issued by the FERC.
FERC Certificate means that certification issued by the Federal Energy Regulatory Commission (“FERC”) (i) authorizing the construction of the Project, including any conditions governing the conduct of the construction activities for the Project, and (ii) detailing the pipeline route and required pipe class associated with the route’s population density survey. The FERC Certificate includes related FERC filing documents CP04-38-00, CP04-38-001, CP04-39-000 and CP04-40-000 and the approved implementation plan.
FERC Certificate means the initial Certificate of Public Convenience and Necessity authorizing Nautilus to provide transportation services on the Nautilus System and approving the initial rates, terms and conditions of service.

  • Transporter’s Failure to Accept FERC Certificate On or before February 28, 2021, Transporter shall have accepted the FERC Certificate to install, construct, acquire and/or secure the Project Facilities and to provide the proposed Firm Service pursuant to the terms and conditions specified herein.

  • If at any time prior to Transporter’s acceptance of the FERC Certificate, Transporter determines, in its reasonable sole discretion, that all or any applicable portion of the Project would not be economic, then Transporter shall have the right to terminate this Precedent Agreement and/or the FTS Agreement, as applicable, without liability to Shipper.

FERC Certificate means the certificate of public convenience and necessity under § 7(c) of the Natural Gas Act, 15 U.S.C. § 717f(c), in response to the Certificate Application filed by Pipeline for authority to acquire, construct, own, operate, and maintain the Project Facilities and to provide firm transportation service on the terms and conditions set forth in this Precedent Agreement. “FERC Certificate Application” means the application to be submitted by Pipeline for the FERC Certificate. “FERC Staff” means the Staff of the FERC with delegated authority to grant or issue authorizations, waivers, and approvals necessary for the Pipeline to construct, own, operate, and maintain the Project Facilities and to provide the firm transportation service contemplated in this Precedent Agreement. “FTSA” means the Firm Transportation Service Agreement to be entered into by Pipeline and Customer, the form of which is attached hereto as Exhibit A. “FTNRA” means the agreement between Pipeline and Customer detailing the negotiated rate that will apply to service under the FTSA to be entered into by Pipeline and Customer, the form of which is attached hereto as Exhibit B. “Firm Transport Agreement” means the applicable FTSA and FTNRA, together. “In-Service Date” means the date as specified in Pipeline’s final notice to Customer that Pipeline is ready and able to provide service to Customer in accordance with the Firm Transportation Agreement. 2
FERC Certificate has the meaning specified in the recitals to this Agreement.
FERC Certificate means the certificate issued February 15, 2007 to the Company in Docket No. CP07-4, et al.
FERC Certificate means the Order Issuing Presidential Permit and NGA Sections 3 and 7 Authorizations issued July 10, 2007 by the Federal Energy Regulatory Commission of the United States of America in Docket Nos. CP07-74-000, CP07-75-000, CP07-76-000 and CP07-77-000, as may be amended from time to time, as a result of a petition by the Company, an Affiliate of the Company, or otherwise.
