Where any information required of the CONSULTANT is in the exclusive possession of another who fails or refuses to furnish this information, the CONSULTANT shall so certify to the FDOT, FHWA, FTA, the FAA, and/or the Federal Motor Carrier Safety Administration as appropriate and shall set forth what efforts it has made to obtain the information.
The CONSULTANT shall provide all information and reports required by the Regulations or directives issued pursuant thereto, and shall permit access to its books, records, accounts, other sources of information, and its facilities as may be determined by the FDOT, FHWA, FTA, Federal Aviation Administration (FAA), and/or the Federal Motor Carrier Safety Administration to be pertinent to ascertain compliance with such Regulations, orders and instructions.
The CONSULTANT shall take such action with respect to any subcontract or procurement as the FDOT, FHWA, FTA, the FAA, and/or the Federal Motor Carrier Safety Administration may direct as a means of enforcing such provisions including sanctions for noncompliance.
The Employer agrees to reimburse current bargaining unit employees who are required to hold a hazmat-endorsed commercial driver’s license for the initial and recertification cost of obtaining or renewing the hazmat endorsement to include the fingerprinting and background check process required by the Transportation Security Administration (TSA) and the Federal Motor Carrier Safety Administration (FMCSA) for issuance of hazmat endorsements.
