Excluded Areas definition

Excluded Areas means the land or waters in respect of which the parties have agreed that no determination of native title is to be made at present being the areas described in Schedule Six and shaded purple on the plan in Schedule Two.
Excluded Areas means the areas identified in the Harbour Plans; “Execution Date” means the last date of execution of this Agreement;
Excluded Areas refers to the ground located immediately under any residence or other substantial, permanent improvements (except driveways), whether currently existing or hereafter constructed, and any point within twenty (20) feet of such residence or other substantial, permanent improvements (except driveways).

More Definitions of Excluded Areas

Excluded Areas means all areas within, or within three kilometres of, the boundary of the areas covered by:
Excluded Areas means those areas of the facility that the Local Authority or Facility Manager feel should not be made available to the public. c. “Local Authority” shall mean the legislative body responsible under the Province of Manitoba Education Administration Act or Activille for the physical assets under this agreement. d. “Normal School Hours” shall mean the hours between 8:30 a.m. and 6:00 p.m. on Monday to Friday of each week. e. “Normal School Year” shall mean from January 1 to June 30 and September 1 to December 31 of each year. f. “School Break Hours” shall mean from 8:00 a.m. to 1:00 a.m. on all days excluding statutory holidays when students are away for normal winter, spring, or summer breaks. g. “Normal Leisure Hours” shall mean from 4:00 p.m. to 1:00 a.m. on Monday to Friday of each week, plus 8:00 a.m. to 1:00 a.m. on Saturday and Sunday. 4
Excluded Areas shall have the meaning set forth in Section 3.01.
Excluded Areas means (i) facilities in the Park in existence as of the Original Effective Date (consisting of associated port-a-cans, irrigation, sports fields (excluding volley ball courts), tennis center, fitness center, swimming pool and the polo practice field, so long as the same is operated in connection with the polo playing field on the adjacent private property of the Bayou Club) until replaced through new construction or until such time as agreed between MPC and the City, and (ii) the easement area required by the Harris County Flood Control District (the “HCFCD Easement Area”) to construct the “Demonstration Project” shown on Exhibit I attached hereto (clauses (i) and (ii), collectively, “Temporary Excluded Areas”), and the “Permanently Excluded Areas,” which include (iii) the golf course located in the Park (the “Golf Course”), including associated landscaping but excluding parking areas, (iv) the Houston Arboretum and Nature Center (the “Arboretum”), (v) the lawn and lighting of the Croquet Court (but not other associated structures and site furnishings or associated programming), (vi) water lines, lift stations and trail bridges located outside of the other Excluded Areas named in this definition, that are maintained by the City through Houston Public Works or as part of the Combined Utility System as of the Effective Date (but excluding water lines “below the meter” and located in non-Excluded Areas), (vii) designated areas of the Maintenance Facility pursuant to Exhibit F, (viii) paved portions of Memorial Drive and Woodway Drive and associated street lighting, and the CenterPoint transmission line easements and (ix) civic art.
Excluded Areas is defined in Section 4.01(A)(1) below.
Excluded Areas means all those portions of the Lands contained within the Franchise Area which as of the Effective Date are serviced by:
Excluded Areas means the following portions of the Licensed Premises during the following specified periods: From July 14, 2012 through August 17, 2012, the basketball practice court and weight training areas; and From July 14, 2012 through August 24, 2012, the Bobcats Locker Room and executive offices.
