ESTABLISHMENT OF TRUST. The Employer shall establish the Trust with the Trustees, pursuant to such terms and conditions as are set forth to the Trust Agreement to be entered into between the Employer and the Trustees. The Trust is intended to be treated as a "grantor" trust under the Code and the establishment of the Trust is not intended to cause Participants to realize current income on amounts contributed thereto, and the Trust shall be so interpreted.
