Pursuant to Sections 261 through 264 of the federal Health Insurance Portability and Accountability Act of 1996, Public Law 104-191, (“HIPAA”), the Department of Health and Human Services (“HHS”) has issued regulations at 45 C.F.R. Parts 160 and 164 (the HIPAA Security Rule, the HIPAA Privacy Rule, the HIPAA Enforcement Rule and the HIPAA Breach Notification Rule, referred to collectively herein as the “Regulations”) to protect the security, confidentiality and integrity of health information.
Lead Registrant may generate or assign the development of the below listed documents for joint submission pursuant to Article 16 of Enforcement Rule of ARECs on behalf of the Parties to a professional organization.
Enforcement Rule" shall mean the Enforcement Provisions set forth in 45 CFR Part 160.
As of the date of this Contract, each party may be a Covered Entity under the Health Insurance Portability and Accountability Act of 1996, as amended (“HIPAA”), and must comply with the Administrative Simplification Provisions of HIPAA and with the applicable provisions of the Health Information Technology for Economic and Clinical Health Act of 2009 ("HITECH Act"), including the Privacy Rule, Security Rule, Breach Notification Rule, and Enforcement Rule (the “HIPAA Rules”).
A reference in this Agreement to a section in the Privacy Rule, the Security Rule, the Breach Notification Rule, the Enforcement Rule or HIPAA means the relevant section as in effect or as amended.
