Enforcement proceeding definition

Enforcement proceeding means an adjudicatory proceeding brought upon a complaint filed pursuant to Section 31 of the Act by the Attorney General, State's Attorney, or other persons, in which the complaint alleges violation of the Act, any rule or regulation adopted under the Act, any permit or term or condition of a permit, or any Board order.

Enforcement proceeding means a proceeding instituted by the competent Competition Authority of a Party against one or more undertakings with the aim of establishing and remedying anti-competitive behaviour.

Enforcement proceeding means any proceeding commenced by the New SRO for the purposes of enforcement, including but not limited to a disciplinary hearing and settlement hearing.

Examples of Enforcement proceeding in a sentence

• Advances shall include any and all reasonable Expenses incurred pursuing an Enforcement Proceeding (assuming for this purpose all references to a “Proceeding” in the definition of Expenses were deemed related to an Enforcement Proceeding), including Expenses incurred preparing and forwarding statements to the Company to support the advances claimed.

• The Company hereby consents to service of process for such Enforcement Proceeding and to appear in any such Enforcement Proceeding.

• Advances shall include any and all reasonable Expenses incurred (or reasonably expected by Indemnitee to be incurred by Indemnitee within three months) pursuing an Enforcement Proceeding (as set term is defined in Section 14 below), including Expenses incurred preparing and forwarding statements to the Company to support the advances claimed.

• For the purposes of this paragraph, assume all references to a “Proceeding” in the definition of Expenses refer an Enforcement Proceeding).

• To the fullest extent permitted by applicable law, the Indemnitee shall not be required to reimburse the Company such amounts advanced if it has been determined pursuant to Section 12 (a) that the Indemnitee is not entitled to indemnification and shall not be required to do so until a final determination has been made with respect to Indemnitee’s entitlement to indemnification under any such Enforcement Proceeding pursuant to Section 14(c).

Enforcement proceeding means any claim or action for a violation of any obligation, duty or standard of conduct under this chapter.
