Employee Transfer Date definition

Employee Transfer Date means in respect of any particular Transferring Employee the date on which the part of the Services to which they are assigned transfers from the Previous Contractor to the Contractor;

Employee Transfer Date means the Transferred Staff’s first day of employment with the Supplier (or its Sub-contractor);

Employee Transfer Date means, with respect to each jurisdiction where Employees will become Transferred Employees in accordance with this Agreement, 12:01 a.m. local time in such jurisdiction on the day immediately following the Closing Date.

• The Supplier must indemnify and keep indemnified the Authority and any Successor against all Losses arising out of any claim by any Eligible Employee that the provision of (or failure to provide) Pension Benefits and Premature Retirement Rights from the Employee Transfer Date, or the level of such benefit provided, constitutes a breach of his or her employment rights.

• Transfer Option As soon as reasonably practicable and in any event no later than twenty (20) Business Days after the Employee Transfer Date, the Supplier must provide the Eligible Employees with the Transfer Option, where a Third Party offered, or the Supplier offers, a Broadly Comparable scheme.

• The Supplier must supply to the Authority at least twenty eight (28) days before the Employee Transfer Date a complete copy of each Direction Letter.

• The Supplier must supply to the Authority details of its Broadly Comparable scheme and provide a full copy of the valid certificate of Broad Comparability covering all Eligible Employees, as soon as it is able to do so and in any event no later than twenty eight (28) days before the Employee Transfer Date.

• If the Authority in its sole discretion agrees that the Supplier or Sub-contractor need not provide the Eligible Employees with access to the NHS Pension Scheme, the Supplier must ensure that, with effect from the Employee Transfer Date until the day before the Subsequent Transfer Date, the Eligible Employees are offered access to a scheme under which the Pension Benefits are Broadly Comparable to those provided under the NHS Pension Scheme.

More Definitions of Employee Transfer Date

Employee Transfer Date means (a) for any Business Employee not on an Employee Leave at the time of the Closing, the Closing Date, (b) for any Business Employee on an Employee Leave at the time of the Closing, the date the Business Employee returns to work from the Employee Leave, and (c) for any Acquired Entity Employee, the Closing Date.

Employee Transfer Date means the date designated by notice given by TD Transferor to the Transferee as the date for the transfer of the Employees to the Transferee; provided that the date so designated shall be on the same day as or after the Effective Time and prior to the first anniversary of the Effective Time;

Employee Transfer Date has the meaning set forth in Section 6.04(b).

Employee Transfer Date means (a) for any Closing Transferred Employee not on an Employee Leave at the time of the Closing, the Closing Date, (b) for any Closing Transferred Employee on an Employee Leave at the time of the Closing, the date the Closing Transferred Employee returns to work from the Employee Leave (provided such Closing Transferred Employee satisfies the requirements set forth in Section 7.1), (c) for any RTP Fab Transferred Employee not on an Employee Leave at the time of the RTP Fab Transfer Date, the RTP Fab Transfer Date, and (d) for any RTP Fab Transferred Employee on an Employee Leave at the time of the RTP Fab Transfer Date, the date the RTP Fab Transferred Employee returns to work from the Employee Leave (provided such RTP Fab Transferred Employee satisfies the requirements set forth in Section 7.1).

Employee Transfer Date means, as applicable, (i) the Closing Date, in respect of the Closing Transfer Employees, (ii) the Cork Manufacturing Transfer Date, in respect of the Cork Transfer Employees, (iii) the Fremont Manufacturing Transfer Date, in respect of the Fremont Transfer Employees, (iv) the West Valley Manufacturing Transfer Date, in respect of the West Valley Transfer Employees, (v) the applicable Deferred Closing Date, in respect of the Deferred Closing Transfer Employees located in a Deferred Closing Country or (vi) the Delayed Transfer Date, in respect of each Delayed Transfer Employee.

Employee Transfer Date means May 1, 2018 or such other date as is mutually agreed to between the parties.

Employee Transfer Date means June 1, 2015.
