Borrower shall obtain and maintain All Risk insurance coverage, which coverages and risks insured meet the standards established in Part V, Section 106 of the Xxxxxx Xxx D.U.S. Guide, effective November 3, 2003, as amended from time to time, to the extent available at commercially reasonable rates and satisfactory to OCD, on the Project, and all movable and immovable property securing the Indebtedness.

The Construction Lender shall subscribe to the DUS Guide throughout the term of this Agreement through the applicable commercial venue.
If the Borrower has incurred or will incur additional debt to cover such difference, such debt cannot be secured by a lien on the Project unless the Project is a Multifamily Affordable Housing Property; in which case the additional debt must be subordinated to the Permanent Mortgage Loan, and the terms, conditions and documentation of the additional debt must meet the requirements for subordinate financing as set forth in the DUS Guide.
Subject to Section 9.1 and to the terms of any outstanding Certificate of Loan Terms issued under this Agreement, but otherwise notwithstanding anything to the contrary in this Agreement, the terms and conditions of this Agreement are subject to change consistent with DUS Guide policy and product changes relating to the Forward Product Line, as applicable, without need of any written amendment to this Agreement.
