In the event there is a dispute concerning the interpretation of this Agreement or any aspect of the Project that the Project Managers are unable to resolve, the Project Manager for either MTC or AGENCY may request that an ad hoc Dispute Resolution Committee (“DRC”) be convened to resolve the dispute.
Step Three - Dispute Resolution Committee shall be comprised of the Director of Human Resources, a representative of the Union and a neutral third party appointed by mutual agreement.
There shall be established a Central Dispute Resolution Committee (“The Committee”), which shall be composed of equal representation of up to four (4) representatives each of the employer bargaining agency and employee bargaining agency (“the central parties”), and up to three representatives of the Crown.
Where a local grievance has been filed, the central parties will jointly recommend in writing to the Local Parties that the local grievance be held in abeyance until the Central Dispute Resolution Committee, the Central Parties, or the Crown takes action under Article 4.
The members of the Central Dispute Resolution Committee (CDRC) may agree to refer central grievances to the expedited mediation process set out in this LOA.
