Examples of Disposal Date in a sentence
Should the Disposal Agent be unable to obtain Full Quotations from at least three (3) Dealers on the Disposal Date, it shall attempt to obtain at least one Full Quotation from at least one (1) Dealer over the next three (3) Business Days (each such Business Day a “ Fallback Disposal Date”) and shall dispose of the Underlying Assets on the first Fallback Disposal Date on which it receives a Full Quotation.
On such Disposal Date, at 11am in the principal market of the Underlying Assets, the Disposal Agent shall attempt to obtain Full Quotations with respect to the Underlying Assets from at least three (3) Dealers on the Disposal Date, and shall sell the Underlying Assets to the highest bidder.
One (1) part (the “Referee Sample”) shall be retained by Seller until the Disposal Date.
Unless Buyer requests an analysis of the Referee Sample before the Disposal Date, Seller’s analysis shall be used to determine the quality of the coal under this Agreement and shall be the Payment Analysis.
If any dispute arises with regard to the analysis of any sample before the Disposal Date for such sample, the Referee Sample retained by Seller shall be submitted for analysis to an independent commercial testing laboratory (“Independent Lab”) mutually chosen by Buyer and Seller.
