Disease Category definition

Disease Category means those groups of common medical conditions, based upon historic data, that have been incorporated into the TDP and identified in the Compensible Disease Matrix in order to facilitate the expedient and efficient processing and liquidation of TDP Valued Asbestos Claims.

  • The Scheduled Values for the Medical Criteria associated with a Disease Category set forth in the Compensable Disease Matrix are based on tort system values and represent equitable settlement values for most TDP Valued Asbestos Claims that meet the Medical Criteria associated with a Disease Category set forth in the Compensable Disease Matrix and the Exposure Evidence.

  • As a TDP Valued Asbestos Claim is reached in the FIFO Processing Queue, the Plan Trust shall evaluate it to determine whether the TDP Valued Asbestos Claim meets the Medical Criteria and Exposure Evidence for a Disease Category.

  • Using the Medical Criteria, the Plan Trust will place a TDP Valued Asbestos Claim in the most serious applicable Disease Category (i.e., the category with the highest values).

  • Unless a holder of a TDP Valued Asbestos Claim qualifies for other treatment under the TDP, the Plan Trust shall value and liquidate each TDP Valued Asbestos Claim at the Scheduled Value specified for the Disease Category set forth in the Compensable Disease Matrix corresponding to such TDP Valued Asbestos Claim.

  • The Plan Trust shall advise the claimant of its determination and, if Allowed, offer the holder of TDP Valued Asbestos Claim the Liquidated Value related to the applicable Disease Category.

  • The Plan Trustees shall assure the substantially equivalent treatment of TDP Valued Asbestos Claims, to the extent reasonably practicable, and may, with the consent of the TAC and the Futures Representative, in addition to the powers set forth elsewhere in the TDP, change, add, or delete Disease Categories, change Medical Criteria, and modify the values for any Disease Category to reflect relevant developments, including, without limitation, changes in the applicable law.

  • If the Plan Trust determines that a TDP Valued Asbestos Claim does not meet the Medical Criteria for a Disease Category and is not compensable, the claimant may dispute the determination as provided in Section 5.1(l).

  • A holder of a PI Trust Claim who, in accordance with these Procedures, resorts to the legal system and obtains a final, nonappealable judgment for money damages shall be paid, when funds are reasonably available, the applicable Pro-rata Percentage of the liquidated value for the relevant Asbestos-Related Disease Category as set forth on Schedule B from time to time amended.

  • The Trustee's decision as to the classification of the claim in a particular Asbestos-Related Disease Category and/or classification of the claim for extraordinary, exigent, or extreme hardship treatment shall be final.

  • A claimant who holds an Extraordinary PI Trust Claim shall receive five times the liquidated value shown on Schedule B for the relevant Asbestos-Related Disease Category multiplied by the applicable Pro-rata Percentage.

Related to Disease Category

  • Product Category means the applicable category which best describes the product as listed in this Section 94508.

  • Transaction Category means the particular type of repurchase transaction effected hereunder, as determined with reference to the term of the transaction and the categories of Securities that constitute Eligible Securities therefor, which term shall include FICASH I Transactions, FICASH II Transactions, FICASH III Transactions, FITERM I Transactions, FITERM II Transactions, FITERM III Transactions, and such other transaction categories as may from time to time be designated by the Funds by notice to Seller, Custodian and Repo Custodian.

  • Category 3 means those affected lands and support facilities if those lands supported operations which were not completed or substantially completed prior to July 1, 1973 (the effective date of the Wyoming Environmental Quality Act) and any affected lands or support facilities taken out of use on or after July 1, 1973 and before May 25, 1975 (the effective date of the Division’s 1975 Rules and Regulations).

  • Clinical psychologist means a person who practices clinical psychology as defined in § 54.1-3600.

  • Specific goals means specific goals as contemplated in section 2(1)(d) of the PPPFA which may include contracting with persons, or group of persons, historically disadvantaged by unfair discrimination on the basis of race, gender and disability including the implementation of programmes of the Reconstruction and Development Programme as published in Government Gazette No. 16085 dated 23 November 1994.

  • Category A means the relevant information which shall be included in the base prospectus. This information cannot be left in blank for later insertion in the final terms;
