Diagnostic Licensed Product definition

Diagnostic Licensed Product means any product used for a diagnostic purpose that, in whole or in part:
Diagnostic Licensed Product means a Licensed Product that is used as a human diagnostic and/or prognostic.
Diagnostic Licensed Product. Diagnostic Licensed Product means any product that (a) embodies a Biomarker Invention, and (b) (i) incorporates or is Developed through the use of AVEO Know-How, or (ii) is Covered by an AVEO Patent Right or Joint Patent Right in the country where such product is used, offered for sale, sold, manufactured, imported or exported.

More Definitions of Diagnostic Licensed Product

Diagnostic Licensed Product means any Licensed Product (including a composition, formulation, device, assay or other product, but excluding Microarrays (as defined in Schedule V)) (a) for sale as an in vitro or in vivo diagnostic for use in or in relation to humans, or (b) for sale separately from but in support of a therapeutic product for use in or in relation to humans.
Diagnostic Licensed Product means a Licensed Product that is intended for the determination, diagnosis, or identification of a disease, condition, characteristic, or trait.
Diagnostic Licensed Product means any diagnostic or diagnostic kit required for use as part of the treatment regimen of a Licensed Product: (a) the manufacture, Use, Sale, offer for Sale, or importation of the diagnostic or diagnostic kit alone or in connection with the administration of a Licensed Product would be covered by a Patent Claim; (b) the Development, manufacturing, regulatory approval, labeling, Use, marketing, Sale or commercialization of that diagnostic or diagnostic kit alone or in connection with the administration of a Licensed Product has been supported by, or benefitted from the access to, any Licensed Information; or (c) which embodies, incorporates, is made with the benefit of any Licensed Information.
Diagnostic Licensed Product means any product, service and/or process which constitutes, is based on, incorporates or utilizes, wholly or in part, Licensed Technology, any and all Derivatives and/or any and all Biological Materials and is used to diagnose or monitor human disease.

  • Licensed Product means any method, process, composition, product, service, or component part thereof that would, but for the granting of the rights set forth in this Agreement, infringe a Valid Claim contained in the Licensed Patents.
