Delivery Facilities definition

Delivery Facilities means the EDC’s physical plant used to provide electric energy to Delaware retail customers, normally inclusive of distribution and transmission facilities.
Delivery Facilities means those portions of the Common Elements on or below street level of the Project as are from time to time designated by the Landlord as facilities to be used in common by the Landlord, tenants of the Project and others for the purposes of loading, unloading, delivery, dispatch and holding of merchandise, goods and materials entering or leaving the Project and giving vehicular access thereto.
Delivery Facilities means the GDC's physical natural gas distribution system used to provide gas service to Delaware retail customers, normally inclusive of Distribution and Transmission Facilities. A GDC that typically operates at pressures of 200 psi or below and that are used to deliver natural gas to customers, up through and including the point of physical connection with natural gas facilities owned by the customer.

Delivery Facilities means those portions of the Common Areas on and below the street level that are from time to time designated by Landlord as facilities to be used in common by Landlord, tenants of the Building, and others, for purposes of loading, unloading, delivery, dispatch and holding of merchandise, goods and materials entering or leaving the Building and giving vehicular access to portions of the Building.
Delivery Facilities means those portions of the Project on and below street level as are from time to time designated by Office Owner, or as are designated by the Existing Loading Dock and Access Easements, as facilities to be used in common by Owners, Occupants, beneficiaries under the Existing Loading Dock and Access Easements, and others for purposes of loading, unloading, delivery, dispatch and holding of merchandise, goods, and materials of whatsoever nature entering or leaving the Building, and giving vehicular access to such portions of the Building. The Delivery Facilities shall be accessible to all Owners and Occupants twenty-four (24) hours per day every day of the year, except for reasonable periods of closure due to maintenance, repair and casualty, and shall be subject to Rules as established by Office Owner in its sole discretion from time to time.
Delivery Facilities means at any time those portions, if any, of the Common Areas in the Building or on the Land on or below grade designated by Landlord from time to time as facilities to be used for the purposes of loading, unloading, delivering, dispatching and holding of letters, packages, merchandise, goods and materials of any kind entering or leaving the Building and giving vehicular access to such portions of the Building, (if any).
Delivery Facilities. (each herein so-called), shall mean those portions of the Project as are from time to time designated by Landlord as facilities to be used in common by Landlord, Tenant, any tenants of the Project and their respective agents, employees, contractors and invitees and such other persons as Landlord may designate, for purposes of loading, unloading, delivery, dispatch and holding of merchandise, goods and materials entering or leaving the Project, and giving vehicular access to the Project and any such facilities within the Project whether or not same are for the exclusive or priority use of any owner or occupant of the Project. Landlord reserves the right to designate any portion of the Delivery Facilities for the exclusive use of any owner and/or occupant as it deems appropriate as long as Tenant is not denied reasonable use of other Delivery Facilities. Notwithstanding the foregoing, it is hereby agreed that the Delivery Facilities that are depicted (and labeled and identified as "Delivery Facilities") on Exhibit "B" attached hereto shall at all times during the Lease Term be available to Tenant for Tenant's non-exclusive use, and Tenant shall, at all times, have access to and from said Delivery Facilities as depicted and so identified on Exhibit "B" attached hereto.

The cost for any construction and maintenance on the NDMC side of the Delivery Point will lie with the NDMC . “Discoms” : shall mean the distribution utility or the distribution utilities who have signed the PSA (s) with NDMC for purchase of thepower purchased; “Dispute” : shall mean any dispute or difference of any kind between NDMC and the REPD, in connection with or arising out of this Agreement including but not limited to any issue on the interpretation and scope of the terms of this Agreement as provided in Article 16 of this Agreement; “Due Date” : shall mean the thirtieth (30th) Day after a Monthly Xxxx or a Supplementary Xxxx is received by NDMC , if such Day is not a Business Day, the immediately succeeding Business Day, bywhich date such Monthly Xxxx or a Supp lementary Xxxx is payable by NDMC;
