Defective Products definition

Defective Products means Products which contain manufactured defects which prevent them from being used for their intended purpose;
Defective Products means any Product which fails to meet the warranty contained in Section 2.8 within the warranty periods described in Schedule A. “Defective Products” shall specifically exclude, without limitation, any Products (i) which have been subjected to misuse, negligence, accident, or improper maintenance, installation, or application or (ii) which have been altered without the Sensor-Technik’s prior written consent.
Defective Products used herein refers to the Product which has been detected or defected during storage or transportation, after it passed the acceptance testing at the inspection conducted by the Distributor.

  • Signify is entitled at its option to replace the Defective Product(s) covered by warranty with a product that has minor deviations in design and/or specifications which do not affect the functionality of the Product.

More Definitions of Defective Products

Defective Products means products shipped by Vendor to Company pursuant to this Agreement that are Defective.
Defective Products means Products that are not in accordance with technical and other specifications specified or otherwise established by SKF or are not fit for the purpose intended. In the absence of documented SKF requirements, "Defective Products" shall mean Products that are not in accordance with approved sample deliveries of the Products or where no samples are delivered, do not conform to generally accepted industry standards.
Defective Products means Products which are defective solely as a result of the faulty design, materials or workmanship of Company and not other causes including without limitation improper use, mishandling, modification, abuse or neglect of Purchaser or its agents. THE FOREGOING REMEDY CONSTITUTES PURCHASER’S SOLE AND EXCLUSIVE REMEDY AND COMPANY’S ENTIRE LIABILITY FOR DEFECTIVE PRODUCTS.

Defective Products are those which fail to operate according to, manufacturer specifications within the first thirty (30) days after receipt by the Buyer. Seller agrees to accept Defective Products, at Buyer's option for either (i) even exchange, and to ship, at Seller's expense, to the address designated by CBQ, an identical replacement within twenty-four (24) hours of receiving notification of such failure or (ii) Seller agrees to accept for unconditional refund Products, returned at Seller's expense, provided that CBQ complies with each of the following conditions:
