Defaulted Shares definition

Defaulted Shares has the meaning ascribed thereto in Section 38 of this Agreement;

Examples of Defaulted Shares in a sentence

  • If the Holder has elected clause (1) to apply, then the Company’s obligation to deliver the Defaulted Shares in accordance with this Note will be deemed to have been satisfied and discharged to the extent the Company has paid the Covering Price in accordance with clause (1).

  • In making the determination whether to suspend or cancel Defaulted Shares, the Board may take into account unique situations in and arrangements made with individual Shareholders.
