Dedicated Properties definition

Dedicated Properties means all interests of Producers and their Affiliates (and their successors and assigns) in oil, gas, or mineral leases, contractual agreements, or other legal rights, insofar, and only insofar, as such interests (i) cover lands located within the Dedication Area and (ii) relate to the Applicable Formations, whether owned on the Effective Date or acquired after the Effective Date, save and except as reserved and excepted as described in Section 5 below.

Dedicated Properties means the interests held by Producer or its Affiliates in the oil and gas leases, mineral interests, and other similar interests as of the Effective Date or acquired by Producer or its Affiliates after the Effective Date that relate to land within the Dedication Area. Notwithstanding the foregoing, (a) any interest that was released pursuant to the Releases of Dedication shall not be included in this definition of “Dedicated Properties”, (b) any interest that is permanently released pursuant to Section 2.4(a) or otherwise, shall cease to be included in this definition of “Dedicated Properties” immediately upon the effectiveness of such permanent release and (c) in the event of an assignment by a Producer (“X”) to an assignee (“Y”) that is permitted under Article 16, any interest that is so assigned shall cease to be included in X’s Dedicated Properties and shall solely be included in Y’s Dedicated Properties as of the effective date of such assignment.

Dedicated Properties means the interests held by Producer or its Affiliates in the oil and gas leases, mineral interests, and other similar interests as of the Effective Date or acquired by Producer or its Affiliates after the Effective Date that relate to land within the Dedication Area. Notwithstanding the foregoing, (a) any interest that was temporarily released pursuant to the Releases of Dedication shall be deemed not included in this definition of “Dedicated Properties” for the duration of such temporary release, (b) any interest that is or was permanently released pursuant to Section 2.4(a) or otherwise shall cease to be included in this definition of “Dedicated Properties” immediately upon the effectiveness of such permanent release, and (c) in the event of an assignment by a Producer (“X”) to an assignee (“Y”) that is permitted under Article 16, any First Amended and Restated Low Pressure Gas Gathering and Compression Agreement interest that is so assigned shall cease to be included in X’s “Dedicated Properties” and, except when assigned to Y free and clear of the Dedications as provided in Section 16.2, shall solely be included in Y’s Dedicated Properties as of the effective date of such assignment.

Examples of Dedicated Properties in a sentence

• By dedicating nearly all of its production within the Dedicated Properties to Defendants, Gulfport gained access to Defendants’ modern and sophisticated gathering system, which without question increases the value and usefulness of Gulfport’s mineral interests.

• Caliber, under the Caliber Contracts, has performed labor and furnished material and services used in connection with the drilling and operation of Nine Point’s oil and gas wells on the Dedicated Properties, including (i) constructing and maintaining pipelines for the provision of materials and services to Nine Point, and (ii) providing ongoing materials and services through those pipelines for use in connection with the drilling and operating of the Debtors’ oil and gas wells.

• Accordingly, Gulfport benefits substantially from the covenants as they allow Gulfport access to Defendants’ gathering system, and Gulfport’s performance of that covenant aids in its enjoyment of its mineral interests because the gathering system provides Gulfport with the only method by which Gulfport’s production within the Dedicated Properties can be marketed and sold.

• Specifically, pursuant to its various contracts and agreements with Nine Point and TUSA, Caliber (a) constructed and maintained pipelines for the provision of materials and services to Nine Point and (b) provided ongoing materials and services through those pipelines for use in connection with the drilling and operating of the oil and gas wells on the Dedicated Properties.

• DSSA shall not be liable for any loss or damage (including missed opportunities or profits) incurred by the Account Holder as a result of the Account Holder using WM Online, including in relation to the execution or (as the case may be) non-execution of any Transaction (or attempted or desired Transaction), except in case of gross negligence or willful misconduct by DSSA.

More Definitions of Dedicated Properties

Dedicated Properties means the Joint Dedicated Properties and any Sole Dedicated Properties dedicated by Shipper from time to time pursuant to Section 2.2.

Dedicated Properties means all Interests now owned or hereafter acquired by Producer or its Affiliates located wholly within the Dedicated Acreage.

Dedicated Properties means all Interests now owned or hereafter acquired by Producer or its Affiliates located wholly within the Dedicated Acreage (other than any Interests excluded from the dedication and commitment pursuant to the terms hereunder).”

Dedicated Properties means (i) Producer’s and/or its Affiliates’ leasehold interest as of the Effective Date within the Contract Area in and to those certain oil, gas and/or mineral leases, as are listed on Exhibit A, and (ii) Producer’s and/or its Affiliates’ interests within the Contract Area in and to any new oil, gas and/or mineral lease acquired by Producer or its Affiliates after the Effective Date, provided that any xxxxx on lands covered by such lease or lands pooled therewith and within the Contract Area are connected to the Gathering System pursuant to Section 4.4.

Dedicated Properties means the Springridge Dedicated Properties.

Dedicated Properties means, collectively, the Xxxxxxx Dedicated Properties, the Midcon Dedicated Properties, and Producers’ Remaining Properties.

Dedicated Properties means the oil and gas leases and other interests described in Exhibit C.
