Data Security Breach definition

Data Security Breach means a breach of security leading to the accidental or unlawful destruction, loss, alteration, unauthorised disclosure of, or access to, Personal Data transmitted, stored, or otherwise processed.
Data Security Breach means any breach of security or confidentiality leading to the accidental or unlawful destruction, loss, alteration, unauthorised disclosure of, or access to, Customer Data;
Data Security Breach is any instance in which the Contractor has actual knowledge or a reasonable basis on which to suspect or conclude that there has been an unauthorized release or access of Confidential Information, regardless of whether the Contractor stores and manages data directly or through a contractor such as a third-party cloud computing vendor. A Data Security Breach may take various forms, including but not limited to: hackers gaining access to data through a malicious attack; lost, stolen, or temporarily misplaced data or equipment (e.g., mobile computing devices or portable memory devices); employee negligence (e.g., leaving a password list in a publicly-accessible location, technical staff misconfiguring a security service or device); or policy and/or system failure.

Examples of Data Security Breach in a sentence

  • If ReliaQuest discovers and has conclusive knowledge of a Data Security Breach or Security Event, ReliaQuest will provide prompt notice to Customer, which in no case will be more than five (5) business days thereafter.

  • ReliaQuest, at its own expense, will investigate, remediate and mitigate the effects of a Data Security Breach or Security Event and, upon request or at reasonable junctures, report to Customer all relevant information, details and findings regarding such activities.

  • In the event of a Data Security Breach or Security Event, ReliaQuest will not notify authorities or media unless: (i) explicit, written permission has been provided by Customer; or (ii) ReliaQuest is otherwise required by law to notify authorities, provided ReliaQuest will makes commercially reasonable attempts to notify Customer in advance of making any such required notification.

  • ReliaQuest will provide Customer with the name and contact information for a primary security contact that will be available to assist Customer, in resolving obligations associated with any Data Security Breach or Security Event.

  • In the event of a Data Security Breach, ReliaQuest shall reasonably cooperate with Customer and Customer’s representatives to provide reasonable assistance to Customer in its efforts to help mitigate the effect of such Data Security Breach.

Data Security Breach means any unauthorised access, modification, use, disclosure, destruction or loss of data related to the Project, and includes an actual or attempted circumvention of any of its security measures. Dispute has the meaning given in clause 35.1 (Dispute resolution).

Data Security Breach. (a) the loss, inadvertent disclosure, unauthorized access to or acquisition of or misuse of Personal Data or any media containing Personal Data; (b) the disclosure or use of Personal Data in a manner inconsistent with Data Protection Laws or the Service Agreement; or (c) any other act or omission that negatively impacts the security, confidentiality, and/or integrity of Personal Data.
Data Security Breach means a security breach as defined by applicable law or any incident that compromises the confidentiality, integrity, or availability of Personal Data.

Data Security Breach means any breach of the minimum information security requirements or any obligations or duties owed by the Company to the user relating to the confidentiality, integrity or availability of confidential information or personal data.
