Data Breach Incident definition

Data Breach Incident or “Data Breach” means the third-party criminal cyberattacks of certain of Checkers independently owned and operated franchisee restaurants involving malware variants targeting customers’ payment card information that occurred between approximately December 17, 2015 and October 12, 2019, and was reported by Checkers on May 29, 2019 and November 15, 2019, respectively, and that is the subject of the Litigation and the Complaints.
Data Breach Incident means any improper or unauthorized intrusion of, access to, or use or disclosure of records, data or information (whether in electronic or non-electronic form) handled, stored or maintained by the subject Person or the electronic systems used by such Person for such handling, storage or maintenance.

Data Breach Incident is circumstances (whether intentional, or unintentional or accidental) that involve actual or a reasonable possibility of unauthorized access to or possession of, or the loss or destruction of, Personal Information, whether ultimately confirmed or not.
