Custody Assets definition

Custody Assets means as defined in Section 15.2 of these Terms;
Custody Assets means, as of any time, all of the Accounts, cash, cash equivalents, Chattel Paper, Deposit Accounts, Documents, Financial Assets, Financial Contracts, General Intangibles, Instruments, Investment Property, Money, Supporting Obligations in respect of the foregoing and Proceeds of all of the foregoing, in each case that, at such time, are in the Custody Account.
Custody Assets. ’ shall mean assets held in the Custody Account on behalf of the Client, which are arranged to be held in safe custody

Examples of Custody Assets in a sentence

  • The Funds enjoy a strong level of protection in terms of Depositary liability for the safekeeping of Custody Assets.

  • The Depositary is liable to the Company for any other losses (other than loss of Held In Custody Assets described above) as a result of negligence, bad faith, fraud, or intentional failure on the part of the Depositary (and each of its directors, officers, servants or employees).

  • In such case, the Depositary shall be liable to return a Held In Custody Assets of an identical type or the corresponding amount to the Company without undue delay, unless the Depositary can prove that the loss arose as a result of an external event beyond its reasonable control, the consequences of which would have been unavoidable despite all reasonable efforts to the contrary.

  • Given the framework of Depositary liability under UCITS V, these Non-Custody Assets, from a safekeeping perspective, expose the Fund to a greater degree of risk than Custody Assets, such as publicly traded equities and bonds.

  • As it is likely that the Funds may each invest in both Custody Assets and Non-Custody Assets, it should be noted that the safekeeping functions of the Depositary in relation to the respective categories of assets and the corresponding standard of liability of the Depositary applicable to such functions differs significantly.

Custody Assets means as defined in Clause 15.2 of these Terms;
Custody Assets has the meaning given to it in clause 20.1 of these Terms;
Custody Assets means Securities, investments and any other assets (whether tangible or intangible) held or received by us for your Account, and, for the avoidance of doubt, shall include any non- currency Margin;
Custody Assets when used in the Agreement and/or any agreements by and between us, including, without limitation, these Terms and Conditions, unless the context otherwise requires, shall mean any shares, stocks, debentures, bonds, securities, or other similar property (including evidence of or title to Securities and all rights in respect of Securities) deposited or transferred by the client or on the client’s behalf with or to us or with or to our sub-custodian or collected by us or by our sub-custodians for the client’s Account;
Custody Assets means your securities or other assets in respect of which we (a) act as a custodian; or (b) arrange for a third party to act as a custodian;
Custody Assets has the meaning ascribed thereto in clause 2.2; “Instructions” has the meaning ascribed thereto in clause 3.2;
Custody Assets means Assets that GS, or any Affiliate or sub-custodian, has agreed with the Fund to take custody of pursuant to the Custodial Services Agreement and for the avoidance of doubt shall include Margin delivered to GS or as directed by GS;
