Current Financial Statements has the meaning given to such term in Section 5.9.

Current Financial Statements is defined in Section 4.8.
Current Financial Statements will mean the following financial statements: (a) Borrower's audited balance sheet dated December 31, 2000 and statement of profit, loss and surplus for the fiscal year ended December 31, 2000; and (b) Borrower's internally prepared balance sheet dated October 31, 2001 and statement of profit, loss and surplus for the period January 1, 2001 through October 31, 2001. For the purposes of any future date on which the representations and warranties contained in Section 4 hereof are deemed to be remade, the most current financial statements, tax returns or other documents with respect to Borrower delivered to Lender pursuant to Section 5 above will be deemed the "Current Financial Statements".
