Current Film definition

Current Film with respect to each Territory shall have the meaning set forth in the applicable Exhibit.
Current Film means a feature-length film (a) that is released theatrically, “direct-to-video” (“DTV”) or on television (“TVM”) in the Territory, (b) the applicable Availability Date for which is either (i) no more than 12 months after its theatrical release in the Territory or, in the case of Sony Pictures Classics releases, no more than 14 months after its initial theatrical release in the Territory, or (ii) no more than four months after the Home Video Street Date in the Territory, or (iii) with respect to a TVM, no more than 6 months after its initial television release in the Territory.
Current Film means a Feature Film (a) that is initially released theatrically, direct-to-video (“DTV”) or on television (“MFT”) in the United States or the Territory, (b) for which a Licensed Language version is available out of stock on hand, (c) with an Availability Date during the Avail Term, (d) the Availability Date for which is (i) for theatrical releases other than Sony Pictures Classics releases, no more than 12 months after its initial theatrical release in the United States or the Territory, or, in the case of a Sony Pictures Classics release, no more than 14 months after its initial theatrical release in the United States or the Territory, (ii) for a DTV, no more than 6 months after its LVR in the United States or the Territory, or (iii) for a MFT, no more than 6 months after its initial television exhibition in the United States or the Territory, and (e) for which Licensor controls without restriction all rights, licenses and approvals necessary to grant the rights granted hereunder (“Necessary Rights”), provided, however, that Licensor shall be deemed to have the Necessary Rights with respect to a Current Film if there are any restrictions contractually agreed to by Licensor after the Agreement Date solely for purposes of excluding such Current Film from this Agreement.

Current Film a feature-length film (i) that is initially released theatrically, direct-to-video (“DTV”) or on television (“MFT”), either in the United States or in the Territory (if initially released theatrically in the Territory, “Local Theatrical”), (ii) with an Availability Date during the Avail Term, (iii) for which Licensor unilaterally controls without restriction all necessary rights to grant the rights granted hereunder (the “Necessary Rights”), and (iv) for which a Licensed Language version is available from stock-on-hand.
Current Film means a feature-length film (a) that is initially released theatrically, “direct-to-video” (“DTV”), or on television (“TVM”) in the Territory, (b) with a VOD Availability Date during the VOD Avail Term, (c) the VOD Availability Date for which is (I) no more than twelve (12) months after its theatrical release in the Territory or, in the case of Sony Pictures Classics releases, no more than fourteen (14) months after its initial theatrical release in the Territory, (II) with respect to a DTV, no more than four (4) months after its Home Video Street Date, or (III) with respect to a TVM, no more than six (6) months after its initial television release in the Territory and (d) for which Licensor unilaterally controls without restriction all necessary exploitation rights, licenses and approvals hereunder (the “Necessary Rights”).
Current Film means a feature-length film made available to Licensee by Licensor for commercial airline in-flight exhibition (a) that was released theatrically, “direct-to-video” (“DTV”) or on television (“TVM”) in the Territory, (b) with an Availability Date during the Avail Term, (c) the Availability Date for which is no more than six (6) months after Licensor first made such film available for commercial airline in-flight exhibition and (d) for which Licensor unilaterally controls without restriction all necessary exploitation rights, licenses and approvals in the Territory necessary to grant the rights granted hereunder (the “Necessary Rights”), including any and all Documentaries released theatrically in the Territory on at least 1,800 screens.
