Notwithstanding the foregoing, this Agreement shall continue in effect during the term specified in any Letter of Commitment, Energy Services Agreement, or other contractual obligation which the Energy Cooperative Member has with the Energy Services Vendor, TASB or the Energy Cooperative under an Energy Cooperative program.
Energy Services Vendors in an Energy Cooperative program are not governed by this provision.
When a student exits the Cooperative program the student’s records shall be transferred to the student’s member district.
Report cards of students attending any Cooperative program shall be issued by the Cooperative.
All equipment, materials and supplies purchased by the Cooperative for the Cooperative program shall become the exclusive property of the Cooperative and shall be chargeable as operating costs under this Agreement.
The member district and the Cooperative will collaborate to determine whether a Cooperative program is appropriate for the student’s educational needs, and if so, will schedule a meeting to intake the student and review the student’s Individualized Education Program.
However, nothing herein shall preclude the Energy Cooperative Member from pursuing, either independently or in conjunction with the Energy Cooperative, a claim against an Energy Services Vendor with whom the Member has a contractual agreement that was entered into through an Energy Cooperative program.
If, at any time, there is a disagreement about the Cooperative program, or the student's activities while on the job, the program may be discontinued at the end of a semester at the request of either party.
