Contractual Claim definition

Contractual Claim means any claim which relates to death or long-term disability of a seafarer due to an occupational injury, illness, or hazard as set out in national law, the SEA or collective bargaining agreement “CBA”.
Contractual Claim means a claim held by a Contractual Claimant;
Contractual Claim shall have the meaning indicated in Section 11(a).

  • Where there has been a determination, at both Step I and Step II, that the specifications do not provide a contractual basis for the resolution of the claim submitted by the Contractor or that the Notice of Claim was filed late without obtaining permission of the Superior Court, the Department reserves the right to conclude the Contractual Claim Resolution Process at the end of the Step II review.

Contractual Claim means a claim other than an Indemnity Claim, a Warranty Claim or a Tax Claim (whether in contract, tort or otherwise) by a Purchaser or another member of the Purchaser's Group against all or any of the Sellers for breach of a term of any of the Transaction Documents or relating to any of the transactions contemplated by such agreements;

  • Contractual Service means the rendering by a contractor of its time and effort rather than the furnishing of specific commodities.   • Contractual Services are defined as those specified services established within the OAG approved budget for which the Provider is to be paid upon completion at the set rate also established within the OAG approved budget, as authorized expenditures eligible for payment, or reimbursement pursuant to ARTICLE 9, AUTHORIZED EXPENDITURES, of this Agreement.

  • Actual Costs as used herein shall mean those costs that were reasonably incurred in order to protect the honesty and integrity of the gaming being operated by Tribe under, and to monitor the Tribe’s compliance with, the Compact. Costs incurred in common for more than one tribe shall be allocated among such tribes. For purposes of this Section 13, prior years’ actual costs shall be based on the actual costs incurred for the twelve months ending September 30. Regulatory Fees shall be paid as follows:

  • Swap Agreement means any agreement with respect to any swap, forward, future or derivative transaction or option or similar agreement involving, or settled by reference to, one or more rates, currencies, commodities, equity or debt instruments or securities, or economic, financial or pricing indices or measures of economic, financial or pricing risk or value or any similar transaction or any combination of these transactions; provided that no phantom stock or similar plan providing for payments only on account of services provided by current or former directors, officers, employees or consultants of the Borrower or the Subsidiaries shall be a Swap Agreement.

  • Contractual Delivery Date means the stipulated date on which the contractor shall attain

  • Swap Contract means (a) any and all rate swap transactions, basis swaps, credit derivative transactions, forward rate transactions, commodity swaps, commodity options, forward commodity contracts, equity or equity index swaps or options, bond or bond price or bond index swaps or options or forward bond or forward bond price or forward bond index transactions, interest rate options, forward foreign exchange transactions, cap transactions, floor transactions, collar transactions, currency swap transactions, cross-currency rate swap transactions, currency options, spot contracts, or any other similar transactions or any combination of any of the foregoing (including any options to enter into any of the foregoing), whether or not any such transaction is governed by or subject to any master agreement, and (b) any and all transactions of any kind, and the related confirmations, which are subject to the terms and conditions of, or governed by, any form of master agreement published by the International Swaps and Derivatives Association, Inc., any International Foreign Exchange Master Agreement, or any other master agreement (any such master agreement, together with any related schedules, a “Master Agreement”), including any such obligations or liabilities under any Master Agreement.
