CONTRACT LIMIT, FEES AND EXPENSES changing the not-to-exceed amount of the Contract from FIVE MILLION FIVE HUNDRED THOUSAND DOLLARS AND ZERO CENTS ($5,500,000.00) to SIX MILLION ONE HUNDRED THOUSAND DOLLARS AND ZERO CENTS ($6,100,000.00), as approved by RRC Commissioners on August 24, 2021.
CONTRACT LIMIT, FEES AND EXPENSES. The total amount of fees to be paid under this Contract through the Original Term and extension terms, if any, (collectively, “Contract Term”) shall not exceed TWO HUNDRED THOUSAND DOLLARS AND ZERO CENTS ($200,000.00).
CONTRACT LIMIT, FEES AND EXPENSES is deleted in its entirety and replaced with the following: “CONTRACT LIMIT, FEES AND EXPENSES. The total amount of fees to be paid by RRC to Contractor under the Contract through the Contract Term shall not exceed NINE HUNDRED THOUSAND DOLLARS AND ZERO CENTS ($900,000.00), the total of which includes the current NTE amount of SIX HUNDRED THOUSAND DOLLARS AND ZERO CENTS ($600,000.00) plus the addition of THREE HUNDRED THOUSAND DOLLARS AND ZERO CENTS ($300,000.00), as approved by the Commissioners on June 13, 2023.” Except as expressly amended above, all provisions of the Contract, as amended, remain in full force and effect. In the event of a conflict among provisions of the Contract, the order of precedence shall be: this Amendment No. 2; DocuSign Envelope ID: C03CB630-F73E-434A-B417-E91A1891C60B then Amendment No. 1; and then Contract No. 455-21-1024A in accordance with section 1.03. ORDER OF PRECEDENCE., therein.

The total amount of fees to be paid by RRC to Contractor under the Contract through the Contract Term shall not exceed FOURTEEN MILLION TWO HUNDRED THOUSAND DOLLARS AND ZERO CENTS ($14,200,000.00), the total of which includes the current NTE amount of THIRTEEN MILLION TWO HUNDRED THOUSAND DOLLARS AND ZERO CENTS ($13,200,000.00), as approved by the RRC Commissioners on August 22, 2023, plus the addition of ONE MILLION DOLLARS AND ZERO CENTS ($1,000,000.00), as approved by the RRC Commissioners on January 30, 2024.”
