Examples of Contract Completion Costs in a sentence
If the Contract Completion Costs are less than the Maximum Contract Price, then, subject to (i) the Contractor’s providing to the Owner all information and documentation required by this Section, and (ii) any other applicable provisions of this Contract including, without limitation, Sections 7.7.3, 7.7.4 and 7.7.5 hereof, the Owner will pay the Contractor the amount described in Section 7.7.1.2. Such payment shall constitute full and Final Payment to the Contractor.
The Owner will, upon full completion of the Work, deliver a written Notice to the Contractor advising the Contractor that the Work has been completed and setting forth the Contract Completion Costs.
If the Contract Completion Costs exceed the Maximum Contract Price, the Contractor shall promptly pay such difference to the Owner upon receipt of such Notice.
If the Contract Completion Costs are less than the Maximum Contract Price, provided that the Contractor has provided all information and documentation required by this Section, the Owner will pay to the Contractor, an amount equal to the lesser of (a) the difference between the Maximum Contract Price and the Contract Completion Costs, or (b) such amount, when added to sums previously paid to Contractor, equitably compensates Contractor for Services satisfactorily performed up to the date of termination.
If the Contract Completion Costs exceed the Maximum Contract Price, Contractor shall pay such difference to the Owner, as described in Section 7.7.1.3 below.
