Construction Consultant definition

Construction Consultant means a third-party architect or engineer selected and retained by Funding Lender, at the cost and expense of Borrower, to monitor the progress of construction and/or rehabilitation of the Project and to inspect the Improvements to confirm compliance with this Borrower Loan Agreement.

Construction Consultant means the construction consultant, if any, engaged by Administrative Agent with respect to the Project.

• Prior to commencement of any work under the Contract and until final payment is made for the work under the Contract (unless otherwise stated herein), Construction Consultant (hereinafter the “Covered Party”) shall, at its sole expense, maintain the following insurance on its own behalf, with an insurance company or companies having an A.M. Best Rating of A-: Class VII or better, and furnish to the Commission Certificates of Insurance evidencing same.

• The Owner may, at its sole option, designate an Owner's Construction Consultant to be present on the site for all or any portion of the Project.

• The Construction Consultant shall be required to act reasonably and in good faith in making determinations and carrying out its duties, rights and responsibilities hereunder.

• In no event will any inspection by the Administrative Agent or the Construction Consultant be a representation that there has been or will be compliance with the Plans and Specifications or that the Construction Work is free from defective materials or workmanship.

Construction Consultant means Tishman Construction Corporation of Nevada, or any other person designated from time to time by the Administrative Agent, the Interim Mall Lender and the Mortgage Notes Indenture Trustee, in their sole discretion, acting pursuant to the Intercreditor Agreement, to serve as the Construction Consultant under the Disbursement Agreement.

Construction Consultant means a person or firm appointed or designated by Lender from time to time to inspect the progress of the Construction of the Improvements and the conformity of construction with the Plans and Specifications, the Budget and the Project Schedule, and to perform such other acts and duties for such other purposes as Lender may from time to time deem appropriate or as may be required by the terms of this Agreement.

On the date hereof, the Construction Consultant is Inspection & Valuation International, Inc.
