Constituents of Concern definition

Constituents of Concern means any substance defined as a "hazardous substance", hazardous waste, hazardous material, pollutant or contaminant by any Environmental Law, any petroleum hydrocarbon and any degradation product of a petroleum hydrocarbon, asbestos, PCB or similar substance, the generation, recycling, use, treatment, storage, transportation, Release or disposal of or exposure to, which is subject to regulation under any Environmental Law.
Constituents of Concern any substance defined, regulated or characterized as a toxic or hazardous substance, hazardous waste, hazardous material, solid waste, pollutant, or contaminant by any Environmental Law or for which liability or standards of conduct are imposed under Environmental Law, including but not limited to Hydrocarbons and related waste, by-products and components, naturally occurring radioactive materials (NORM), polychlorinated biphenyls, asbestos, and radioactive material.
Constituents of Concern means petroleum substances (and any components, fractions or derivatives thereof), exploration and production wastes, and any other substance, in each case, to the extent defined or regulated as a hazardous substance, toxic substance, hazardous waste, hazardous material, radioactive material, radioactive waste, pollutant, or contaminant by any Environmental Law.

Examples of Constituents of Concern in a sentence

  • Contractor shall be responsible for controlling, containing, and duly removing all Constituents of Concern brought to the Site by Contractor, Subcontractors, Suppliers, or anyone else for whom Contractor is responsible, and for any associated costs; and for the costs of removing and remediating any Hazardous Environmental Condition created by the presence of any such Constituents of Concern.

  • The provisions of Paragraphs 5.03, 5.04, and 5.05 do not apply to the presence of Constituents of Concern or to a Hazardous Environmental Condition uncovered or revealed at the Site.

  • The presence of Constituents of Concern that are to be removed or remediated as part of the Work is not a Hazardous Environmental Condition.

  • The presence of Constituents of Concern as part of the routine, anticipated, and obvious working conditions at the Site, is not a Hazardous Environmental Condition.

  • Owner represents to Engineer that as of the Effective Date to the best of Owner’s knowledge no Constituents of Concern, other than those disclosed in writing to Engineer, exist at or adjacent to the Site.


More Definitions of Constituents of Concern

Constituents of Concern means those constituents identified pursuant to the approved RFI Workplan.
Constituents of Concern. (COC) means those chemical compounds which have been frequently encountered during sampling events and have been selected as having a reasonable likelihood of having been or might be released, are consistent with the Conceptual Site Model, and pose an adverse hazard or risk to human health or the environment. The COCs are listed in Attachment 3 of the Permit.
Constituents of Concern means the specific regulated substances that may contribute to unacceptable exposure at a site.

Constituents of Concern means any material, substance, pollutant or waste (whether solid, liquid or gaseous) as it is defined, listed or designated as a hazardous substance, hazardous waste, special waste, petroleum or petroleum-derived substance or waste, or any constituent or combination of any such material, substance, pollutant or waste, the storage, manufacture, generation, treatment, transportation, release, remediation, use, handling or disposal of which is regulated by any applicable Environmental Law due to its hazardous, toxic, dangerous or deleterious properties or characteristics.
Constituents of Concern means (i) any pollutant, contaminant, waste or chemical or any toxic, radioactive, ignitable, corrosive, reactive or otherwise hazardous substance, waste or material, or any substance, waste or material having any constituent elements displaying any of the foregoing characteristics; (ii) any substance defined as a hazardous substance, hazardous waste, hazardous material, pollutant or contaminant, or words of similar import, under any Environmental Law; (iii) petroleum and any of its degradation products, by-products and derivatives, any other hydrocarbons, to the extent that any of the foregoing is subject to regulation under any Environmental Law; and (iv) asbestos, asbestos-containing materials and polychlorinated biphenyls.
