Constituent means any State resident or other person

Constituent means a party to a plan of merger, including the survivor.

Constituent or “Affiliate” shall mean an entity which directly or indirectly either controls, is controlled by, or is under common control with, the relevant person (which in case of the Selected Bidder shall include any member of Selected Bidder). • If FORTE fails to fund AGENCY’s account in an amount corresponding to a Constituent’s payment, AGENCY’s sole recourse shall be to FORTE, not the Constituent.
