Consistent Failure definition

Consistent Failure means any of:
Consistent Failure. Means any of: two (2) or more failures by the Supplier to comply with the Standards in any rolling period of twelve (12) Months; two (2) or more failures by the Supplier to accept an Order within two (2) working Days of receipt in any rolling period of twelve (12) Months; two (2) or more consecutive failures by the Supplier to provide the Management Information by the Reporting Date at any time during the Term; or any two (2) or more failures by the Supplier to meet the KPI Targets (whether the failures relate to the same or different KPI Targets) in relation to one or more Call-Off Agreements in any rolling period of twelve (12) months.
Consistent Failure means: (a) two (2) or more failures by the Supplier to accept requests submitted to it to enter into Call Off Agreements pursuant to this Framework Agreement in any rolling period of twelve (12) Months; (b) more than one (1) under or overpayment of the Management Charge being revealed by an Audit at any time during the Term; or (c) two (2) or more consecutive failures by the Supplier to provide the Management Information by the Reporting Date at any time during the Term.

Examples of Consistent Failure in a sentence

  • The Authority may terminate this Framework Agreement by serving notice on the Supplier in writing with effect from the date specified in such notice where a Consistent Failure has occurred.

  • At its sole discretion the Authority has the right to terminate this Framework Agreement pursuant to Clause 26 (Termination) in the event that a Consistent Failure or a Material Default occurs.

  • Notwithstanding anything other rights available to the Authority in this Framework Schedule 8, the Authority may terminate or suspend this Framework Agreement pursuant to clause 27 (Termination) in the event a Consistent Failure or a Material Default occurs.

  • Without prejudice to the Authority's rights to terminate this Framework Agreement as set out in Clause 26 (Termination), if a right to terminate this Framework Agreement arises in accordance with Clause 26 (Termination), or if the Authority reasonably believes that a Consistent Failure has occurred, the Authority may suspend the Supplier’s appointment to provide Goods and Services to Contracting Bodies under this Framework Agreement by giving notice in writing to the Supplier.

  • Without prejudice to the Authority's rights to terminate this Framework Agreement as set out in Clause 27 (Termination), if a right to terminate this Framework Agreement arises in accordance with Clause 27 (Termination), or if the Authority reasonably believes that a Consistent Failure has occurred, the Authority may suspend the Supplier’s appointment to provide Goods and Services to Contracting Bodies under this Framework Agreement by giving notice in writing to the Supplier.

Consistent Failure means:- two (2) failures to comply with the Quality Measures in any period of twelve (12) Months; two (2) number of failures to accept Orders submitted to it pursuant to this Framework Agreement in any period of twelve (12) Months; or more than one under- or overpayment of the Management Charge being revealed by an Audit;

Consistent Failure shall have the meaning set out in Part 1 of 0. Contract Year: a period of 12 months, commencing on the Commencement Date Crown: the government of the United Kingdom (including the Northern Ireland Assembly and Executive Committee, the Scottish Executive and the National Assembly for Wales) including, but not limited to, government ministers and government departments and particular bodies, persons and government agencies. Crown Body: any department, office or agency of the Crown.

Consistent Failure means any of: two or more failures to accept an Order in accordance with the Ordering Procedures without the Authority’s Agreement under Clause 8 of Schedule 5 in any rolling period of twelve (12) months two (2) or more failures by the Service Provider to comply with the Standards in any rolling period of twelve (12) Months; two (2) or more consecutive failures by the Service Provider to provide the Management Information by the Reporting Date at any time during the Term; any failure by the Service Provider to meet the KPI Performance Report Target Score in any three consecutive calendar months; or a Service Improvement Notice or Request for a Service Improvement Plan being served upon the Service Provider in accordance with Schedule 8 of the Call-Off Agreement on more than three occasions over any six month rolling period;
Consistent Failure means: Three or more defaults by a Supplier of a consistent nature; Two of more consecutive failures by the Supplier to provide the Management Information by the Reporting Date; Ten or more failures to achieve the Service Level minimum standard in any Service Aspects (aggregated across all Contracting Bodies) in any three month period; or Eight or more failures to achieve the Service Level minimum standard in any two Service Aspects for one Contracting Body in any six month period
Consistent Failure means the Council serving 3 Remediation Notices in a rolling 3 month period or 2 Default Notices in a rolling 6 month period;
