If the employer and the employee agree the area they are working in is unsafe, the following shall apply; Where practical employees will accept being transferred to an area or site that is not affected by inclement weather, if in the opinion of the Employer that useful work can be carried out at the alternative area or site. When the above is not possible, employees will be encouraged to use non-productive time in further skills training or job planning when the situation permits this to occur. Such training shall be relevant and meaningful and will be carried out by a suitably competent person and where practicable shall be completed to an appropriate stage. The training shall include: * Quality Assurance, * Safety, * Environmental, * Industry recognised programmes, * NBCITC Accredited Modules, * Other training relevant to the project. Subject to compliance with the above, employees will continue to be paid during periods of inclement weather, even where employees either remain on site or are sent home. Employees are not expected to remain on site for more than half of the remainder of the day where inclement weather is agreed.

It is agreed by the Parties that prior to any Employee leaving the worksite due to Inclement Weather, consultation will take place between the Employee or Employee representative and the Employer. Where the Weather is such and work is unable to be carried out in a safe manner, the Employer may direct Employees to alternative work arrangements, which may include training. Where a work location is affected by Inclement Weather, Employees not affected will continue to work as normal, regardless that some Employees may be entitled to cease work due to unsafe conditions.
