Conditions of Trade or “COT” means these Conditions of Trade for Container Terminals;

  • Any document or information referred to in these Conditions of Trade, and capable of being accessed by way of an internet address, shall be deemed to be incorporated in these Conditions of Trade in accordance with the provisions of the Electronic Communications and Transactions Act, No. 25 of 2002.

  • If any of the Goods are damaged or destroyed prior to property in them passing to the Buyer, the Seller is entitled, without prejudice to any of its other rights or remedies under these Terms and Conditions of Trade (including the right to receive payment of the balance of the Price for the Goods), to receive all insurance proceeds payable for the Goods.

  • However, ABP reserves the right to amend the ABP Standard Terms and Conditions of Trade at any time by publishing the Conditions on ABP’s website (www.abports.co.uk).

  • The Customer shall not be entitled to cancel an Order other than as allowed pursuant to these Terms and Conditions of Trade.

  • Without prejudice to such other rights as the Vendor may have pursuant to these Terms and Conditions of Trade, the Vendor reserves the right to request from the Customer such security as the Vendor may from time to time think desirable to secure to the Vendor all sums due to the Vendor and may refuse to supply further Goods and Services to the Customer until such security is given.

  • Contractual details can be found in Section 5 of ONTRAS’ Supplementary Terms and Conditions of Trade of ONTRAS.

  • Unless otherwise expressly agreed in writing, it is not a condition of these Terms and Conditions of Trade or any Order that the Goods and Services will correspond precisely with such dimensions and specifications and customary tolerances or in the absence of customary tolerances, reasonable tolerances shall be allowed.

  • Failure by the Vendor to enforce any of the terms and conditions contained in these Terms and Conditions of Trade shall not be deemed to be a waiver of any of the rights or obligations the Vendor has under these Terms and Conditions of Trade.

  • Any personal liability of a signatory hereto shall not exclude the customer in any way whatsoever from the liabilities and obligations contained in these Terms and Conditions of Trade.

Related to Conditions of Trade

  • Conditions of Use means Conditions 1 to 10 and the Schedules and Appendices of this document.

  • Conditions of Tender means the Conditions of Tender for the said land as set out in Annexure A;

  • means of transport means rail transport, road freight transport, inland waterway transport, maritime transport, air transport, and intermodal transport;

  • Conditions of Carriage means these conditions of carriage.

  • Regulations of the U.S. Department of Transportation means the regulations in 49 CFR Parts 100-189.

  • Conditions of Sale means the Conditions of Sale set out in Part 3 of this TenderDocument;

  • Conditions of Issue means the Conditions of Issue of Octopus published by us as amended from time to time, which can be obtained from us or downloaded from our website at www.octopus.com.hk ;

  • General Conditions of Contract means the ‘Instructions to Tenderers’ and ‘General Conditions of Contract’ pertaining to the work for which above tenders have been called for.

  • Conditions of Approval means condition(s) imposed by the Municipality in the approval of a land development application, including any conditions contained in the annexure(s) and/or plans and/or attachment(s) that form part of the approval and/or are referred to in the approval of the land development application;

  • Tool of Trade means:a Vehicle that has tools, implements, machinery or plant attached to or towed by the Vehicle and is being used by You at Your premises or on any Worksite. Tool of Trade does not include any Vehicle whilst travelling to or from a Worksite or Vehicles that are used to carry goods to or from any premises.

  • Conditions of Contract means those statements contained in or delivered with your Ticket/s or Itinerary/Receipt, identified as such and which incorporate by reference, these Conditions of Carriage and notices.

  • the Conditions means the standard terms and conditions set out in this document;

  • Conditions of Service means the document developed by a distributor in accordance with subsection 2.4 of the Code that describes the operating practices and connection rules for the distributor; (DSC)

  • General Conditions means the “International Development Association General Conditions for Credits and Grants”, dated July 1, 2005 (as amended through October 15, 2006).

  • Special Conditions of Contract means the pages completed by the Procuring Entity entitled Special Conditions of Contract which constitute Part A of the Special Conditions.

  • GENERAL AND SPECIAL CONDITIONS OF CONTRACT means the instructions to Tenderer and General and special conditions of contract pertaining to the work for which above tenders have been called for.

  • Termination of Trading means that the Common Stock or other securities into which the Securities are convertible is neither listed for trading on a U.S. national securities exchange nor approved for trading on an established automated over-the-counter trading market in the United States.

  • Specifications and Standards means the specifications and standards relating to the quality, quantity, capacity and other requirements for the Project Highway, as set forth in Schedule-D, and any modifications thereof, or additions thereto, as included in the design and engineering for the Project Highway submitted by the Contractor to, and expressly approved by, the Authority;

  • Codes and Standards means all the applicable codes and standards as indicated in the Technical Specification.

  • General Conditions Cost means costs incurred and minor work performed by Contractor without the need for competitive bids/proposals. The allowable General Conditions items are limited in Paragraph 11.1 and are further described on Exhibit “D”. The maximum allowable General Conditions Cost payable to Contractor during the Construction Phase of the Project is set out in Exhibit “A” attached to this Agreement.

  • Condition of the Company means the Assets, business, results of operations and/or financial condition of the Company.

  • Communications Provisions means the Communications Provisions in [Part 10, Chapter 4] of the General Regulations.

  • In the course of transportation means in the course of transportation within the United States, or in the course of transportation outside the United States and any other nation, including handling or temporary storage incidental

  • Terms & Conditions means the Special Conditions of Contract and General Conditions of Contract herein mentioned and other stipulations incorporated in any part of Tender Document and /or Agreement.

  • Reservations Any reservation for oil, gas, or other minerals, water, timber, or other interests is made in accordance with an attached addendum.
