Completed Facility definition

Completed Facility means an Eligible Project which has met the conditions set forth in Section 4.3 Conditions Under Which an Eligible Project is a Completed Facility of this Agreement.
Completed Facility means a manufacturing facility that is operating in accordance with requirements in the Preliminary Certificate and performance agreement between the Department and the Applicant for which all costs have been paid or committed by a binding contract or agreement.
Completed Facility means a Facility for which the Facility Completion Date has occurred.

Completed Facility shall have the meaning set forth in Recital A.
Completed Facility means an Eligible Project which has met the conditions set forth in Section 2.06 of the Construction Loan Agreement.
Completed Facility means a Facility that shall have been fully constructed, completed and operational prior to becoming Leased Property and for which only one Construction Advance shall be made. The term “Examined Facilities” does not include any facility exempt from an Offer Floor pursuant to the provisions of Section 23.4.5.7.7. Exceptional Circumstances: shall mean one or more unavoidable circumstances, as determined by the ISO, that individually or collectively render as unavailable the data necessary for the ISO to perform an audit and review of a Market Party, pursuant to Section 23.4.5.6.2 of this Services Tariff. Exceptional Circumstances may include, but are not limited to: the inaccessibility of the physical facility; the inaccessibility of necessary documentation or other data; and the unavailability of information regarding the regulatory obligations with which the Market Party will be required to comply in order to return its Generator to service which regulatory obligations are not yet known but which will be made known by the applicable regulatory authority under existing laws and regulations provided that none of the above described circumstances are the result of delay or inaction by the Market Party. The magnitude of the repair cost, alone, shall not be an Exceptional Circumstance.

  • Capital Improvement Project means the acquisition, construction, reconstruction, improvement, planning and equipping of roads and bridges, appurtenances to roads and bridges to enhance the safety of animal-drawn vehicles, pedestrians, and bicycles, wastewater treatment facilities, water supply systems, solid waste disposal facilities, and storm water and sanitary collection, storage and treatment facilities including real property, interests in real property, facilities, and equipment related or incidental to those facilities.

  • Facility Site shall have the meaning set forth in the recitals to the Facility Site Lease.
