Comparable service definition

Comparable service means any regulated service or goods whose availability, quality, price, terms, and conditions are the same as or better than those of the services or goods that the natural gas company provides to a person with which it is affiliated or which it controls, or, as to any consumer, that the natural gas company offers to that consumer as part of a bundled service that includes both regulated and exempt services or goods.
Comparable service means gathering service provided to third parties in the same portion of the Dedicated Area (i.e. the East Dedicated Area or the West Dedicated Area) and at interconnections into Gatherer's System within the same parameters set forth in Section 3.4. For example, in the event Gatherer extends gathering service for receipt into Gatherer's System in the East Dedicated Area under the parameters set forth in Section 3.4(a) at a rate of *********, then all rates payable by Owner for service in the East Dedicated Area shall be multi lied by the fraction ******** and rates in the West Dedicated Area would not be reduced. Rates payable by Owner for service in the East Dedicated Area or the West Dedicated Area, as applicable, shall not be reduced unless Gatherer has given a lower rate to the third party for service in such area. 8.4 Owner shall have the option, to be exercised in writing no later than thirty (30) days prior to the end of each Contract Year to convert to firm service a portion of the gathering service to be rendered under this Agreement (such election to be effective on the first day of a Month specified in Owner's notice during the immediately succeeding Contract Year). For such firm service, Owner shall pay Gatherer, in lieu of the charges per Mcf set forth in Section 8.1, an advance monthly demand charge equal to the applicable per unit charge in Section 8.1 multiplied by a quantity determined in this Section 8.4.
