Company Product or Service definition

Company Product or Service means any product or service provided, licensed or sold by the Company and/or any of the Company Subsidiaries during the past three (3) years.
Company Product or Service has the meaning set forth in Section 3.13(c).
Company Product or Service means any product or service produced, manufactured, marketed, licensed, sold, furnished, distributed or performed by the Company or any of its Subsidiaries at any time prior to the Closing.

More Definitions of Company Product or Service

Company Product or Service means each of the current commercial products and services designed, developed, produced, manufactured, assembled, sold, leased, licensed, marketed, distributed or otherwise made commercially available by the Company Group as of the Agreement Date that are material to the Company Business. The representations of this Section 3.12(a) do not constitute Intellectual Property non-infringement representations, which are covered by Section 3.12(b) below.
Company Product or Service shall have the meaning specified in Section 4.14(c) of the Agreement.
Company Product or Service means each of the products (including software products), the Acquired Companies’ websites (including the websites listed on Schedule 1(a)) (the “Websites”) and services made, manufactured, marketed, licensed, sold distributed, offered or performed by any of the Acquired Companies through the Websites or otherwise at any time and each product, enhancement, derivative, technology, Websites and service currently under development by any of the Acquired Companies.

(e) "Computer software" or "Software" shall mean any computer software containing full and complete computer code, including the Source Code, the Assembly Code, the Object Code and such data files and other files as are deemed necessary for such computer software to achieve its functional purpose. (f) "Object Code" shall mean the form of computer program which can be directly executed by the computer without translation by other computer programs (without regard to the media it is conveyed in). Such form is dictated by the designer of the computer and is usually in a coded form convenient to the machine, but not particularly suited for human interpretation. (g) "Software Product" shall mean any product or Computer software developed by Company during the Term (as defined in paragraph 3 below). (h) "Source Code" shall mean the form of computer Program as prepared by the programmer. Such form may be processed by algorithmic means to -produce the object program.
Company Product or Service means each of the products and services currently produced, manufactured, marketed, licensed, sold, distributed or performed by or on behalf of the Company and the Company Subsidiaries and each product and service currently under development by the Company or any Company Subsidiary. “Company Securityholders” means the Company Stockholders and Company Optionholders, collectively.

Related to Company Product or Service

  • Competing Product or Service means any product or service that is sold in competition with, or is being developed and that will compete with, a product or service developed, manufactured, or sold by Fiserv. For purposes of this Section 5, Competing Products or Services as to you are limited to products and/or services with respect to which you participated in the development, planning, testing, sale, marketing or evaluation on behalf of Fiserv during any part of your employment with Fiserv, or after the termination of your employment, during any part of the 24 months preceding the termination of your employment with Fiserv, or for which you supervised one or more Fiserv employees, units, divisions or departments in doing so.

  • Financial product or service means any product or service that a financial institution or a financial holding company could offer by engaging in any activity that is financial in nature or incidental to such a financial activity under section 4(k) of the Bank Holding Company Act of 1956 and that is offered by the Employer or an affiliate on the date of the Executive’s employment termination, including but not limited to banking activities and activities that are closely related and a proper incident to banking.
