For the avoidance of doubt Service Credits shall be payable without the need for the Communications Provider to make a claim.
For claims relating to the provision of Calling and Network features where evidence indicates a failure could not have been identified in the first 6 months after the provision, a Communications Provider may submit a claim up to 12 months after the Calling and Network feature provision order was submitted.
If BT fails to do this, then providing the Communications Provider advises BT via Buzzcom within 2 hours of BT’s provision of the first CDR fraud feed which shows that BT has not implemented Carrier Pre-Selection on time, the Communications Provider shall have the entitlement set out in paragraph 4.8.
If BT fails to do this, the Communications Provider shall be entitled to the compensation set out in paragraph 4.1 of this Schedule.
If BT fails to meet the CCD then the Communications Provider shall be entitled to 100% of the relevant individual DFX Service monthly rental for every Working Day or part Working Day beyond the CCD up to a maximum of 60 Working Days.
