Commonwealth Funded Building Work means Building Work in items 1-8 of Schedule 1 of the Building Code.

Commonwealth Funded Building Work. Means Building Work in items 1- 8 of Schedule 1 of the Building Code 2016, other than Building Work to which item 10 of that Schedule applies. Commonwealth Risk Any one of: faulty design carried out by persons other than the Contractor or persons for whom the Contractor is responsible; any negligent act or omission of the Commonwealth or an employee of the Commonwealth performing duties in the Commonwealth Department of Defence or as a member of the Australian Defence Force; war, invasion, act of foreign enemies, hostilities (whether war is declared or not), civil war, rebellion, revolution, insurrection or military or usurped powers, martial law or confiscation by order of any government or public authority; the use or threat of unlawful violence against persons or property which does not arise out of any individual relationship between the perpetrator and the victim, or for purposes of robbery, but which is directed at victims as members of a class, race, organisation, nationality, religious or ethnic group, or which is intended to intimidate, coerce or inflict revenge upon any civilian population, government, institution or corporation; and ionising radiations or contamination by radioactivity from any nuclear fuel or from any nuclear waste from the combustion of nuclear fuel not caused by the Contractor or persons for whom the Contractor is responsible.

  • The Recipient must ensure that it and its Contractors: comply with the clauses contained in a contract referred to in item 1.2(e)(ii) ; and in respect of any downstream agreements, import model clauses (as applicable) from the ABCC’s Building Code’s Funding entity and recipient model clauses – Indirectly Commonwealth Funded Building Work (April 2017) and correctly incorporate any such model clauses in those subsequent agreements.

The Participant must ensure that any request for expressions of interest or request for tender (howsoever described) for Commonwealth Funded Building Work requires a respondent: to confirm that the respondent and any related entity will comply with the Building Code when undertaking the Commonwealth Funded Building Work; to confirm that the respondent, and any related entities, will comply with the Building Code from the time of lodging an expression of interest or tender response (if not already obliged to do so); to confirm that it is not subject to an Exclusion Sanction at the time of lodging an expression of interest or tender; to demonstrate a positive commitment to the provision of appropriate training and skill development for their workforce. Such commitment may be evidenced by compliance with any state or territory government building training policies and supporting the delivery of nationally endorsed building and construction competencies; to include details of the number of current apprentice and trainee employees and the number and classes of persons that hold visas under the Migration Xxx 0000 that are engaged by the respondent, and that are intended to be engaged by the respondent to undertake the Commonwealth Funded Building Work; to advise whether the respondent has, within the preceding 3 year period: had an adverse decision, direction or order made by a court or tribunal for a breach of a designated building law, work health and saf...
Commonwealth Funded Building Work means Building Work in items 1-8 of Schedule 1 of the Building Code, other than Building Work to which item 10 of that Schedule applies.
