Commercially Sensitive definition

Commercially Sensitive means in relation to a Disclosing Party that the disclosure of such information is either a trade secret or if disclosed would prejudice the commercial interests of that Party, and shall include any Operator Information identified as Commercially Sensitive in Part 4 of Schedule 4;
Commercially Sensitive means the Supplier’s Confidential Information listed in Framework Schedule 12 (Commercially Sensitive Information) Information" of the Framework Agreement comprised of commercially sensitive information: (a) relating to the Supplier, its IPR or its business or information which the Supplier has indicated to the Authority that, if disclosed by the Authority, would cause the Supplier significant commercial disadvantage or material financial loss; and (b) that constitutes a trade secret.
Commercially Sensitive has the meaning given to it in clause 59.1.3 (Duty to Co-operate);

  • Before publishing the Transparency Information to the general public in accordance with clause A14.a, the Authority shall redact any Information that would be exempt from disclosure if it was the subject of a request for Information under the Freedom of Information Xxx 0000 or the Environmental Information Regulations 2004, and any Information which has been acknowledged by the Authority at Schedule 9 – Contractor Commercially Sensitive Information.
