Collateral Instrument definition

Collateral Instrument means any note, xxxx of exchange, certificate of deposit or other negotiable or non‑negotiable instrument, guarantee, letter of credit, deposit agreement, indemnity or other assurance against financial loss, or any other document or instrument which contains or evidences an obligation (with or without security) to pay, discharge or be responsible directly or indirectly for, any indebtedness or liabilities of the Company, and includes any document or instrument creating or evidencing an encumbrance, however defined and includes, without limitation, an escrow agreement;
Collateral Instrument means any note, xxxx of exchange, certificate of deposit and other negotiable and non-negotiable instruments, guarantees, indemnities and other assurances against financial loss and any other documents or instruments which contain or evidence an obligation (with or without security) to pay, discharge or be responsible directly or indirectly for, any indebtedness or liabilities of the Borrowers or either of them or any other person liable under the Security Documents and includes any documents or instruments creating or evidencing a mortgage, charge (whether fixed or floating), pledge, lien, hypothecation, assignment, trust arrangement or security interest of any kind;
Collateral Instrument means any Letter of Credit, Performance Bond or Guarantee issued, extended or renewed by the Issuing Bank for the account of the Borrower pursuant to Clause 2B hereof.
