Clear and Reasonable Warnings. Commencing on or before December 31, 2022 (the compliance date), the Settling Entity shall provide clear and reasonable warnings for all units of the Products offered for sale to California consumers or its customers. Each warning shall be prominently placed with such conspicuousness as compared with other words, statements, designs, or devices as to render it likely to be read and understood by an ordinary individual under customary conditions of purchase or use.
Clear and Reasonable Warnings. 2.2.1 For any Products that are not Reformulated Products, such Products shall be accompanied by a clear and reasonable warning. Xxxxxx shall provide the following warning statements (or other warnings consistent with 27 Cal. Code Regs. § 25601, et seq. operative August 30, 2018, or the applicable regulations governing such warnings) as follows:

Within 30 days of the Effective Date, and continuing thereafter, Dynacraft shall provide clear and reasonable health hazard warnings, in accordance with this Section and pursuant to California Health & Safety Code § 25249.5 et seq. and title 27 California Code of Regulations (“Cal. Code Regs.”) § 25600 et seq, as may be amended from time to time, for all Products Dynacraft manufactures, imports, distributes, sells, or offers for sale, in or into California, that do not meet the Reformulation Standard. Each warning shall be prominently placed with such conspicuousness, as compared with other words, statements, designs, or devices, as to render it likely to be read and understood by an ordinary individual under customary conditions prior to purchase or use. Each warning shall be provided in a manner such that the consumer or user understands to which specific Product the warning applies, so as to minimize the risk of consumer confusion. For purposes of this Agreement, the following warnings shall be deemed clear and reasonable:
Clear and Reasonable Warnings. XYZ affixed the warnings below to the packaging for all filament Covered Products beginning on July 15, 2019. XYZ has affixed the warnings below to the packaging for all 3D printer Covered Products beginning on January 20, 2020. WARNING: This product can expose you to chemicals including styrene which is known to the State of California to cause cancer. For more information, visit xxx.X00Xxxxxxxx.xx.xxx. XYZ will continue to provide such warnings for all Covered Products distributed or offered for sale in California, but will modify the warning for 3D printers as follows within 45 days of the Effective Date. For 3D Printers WARNING: This 3D Printer - when used with a styrene filament (ABS / HIPS / or PC- ABS) can expose you to chemicals, including Styrene, which is known to the State of California to cause cancer. For more information, visit www.P65 Xxxxxxxx.xx.xxx. XYZ shall affix the above warning statements to or print them on the Covered Products packaging, and print the warning statements in the Covered Products’ instruction booklets (if any). XYZ shall also ensure that the warning statements are included in any online material promoting the Covered Products which may be viewed by consumers in California - on each Covered Products’ display page or by otherwise prominently displaying the warning statement to the purchaser prior to completing the purchase. The warning statements shall be displayed with such conspicuousness, as compared with other words, statements, designs, or devices as to render them likely to be read and understood by an ordinary individual under customary conditions of purchase or use. Warnings may be contained in the same section of the instruction booklets that contains other safety warnings concerning the use of the Covered Products. The type size of the warning must be legible, and no smaller than any other warning provided with the Covered Products and in no case less than twelve (12) point font. The word

As of the Effective Date, all Products MSC sells and/or distributes for sale in California that do not qualify as Reformulated Products, per Section 2.1, shall bear a clear and reasonable warning pursuant to this Section. MSC further agrees that the warning will be prominently placed with such conspicuousness when compared with other words, statements, designs or devices as to render it likely to be read and understood by an ordinary individual under customary conditions of use. For purposes of this Settlement Agreement, a clear and reasonable warning for the Products shall consist of a warning affixed directly to the product or product packaging, label, or tag, for Products sold in California, and contain one of the following statements: WARNING: Reproductive Harm- xxx.X00Xxxxxxxx.xx.xxx OR WARNING: This product can expose you to chemicals including lead, which are known to the State of California to cause birth defects and other reproductive harm. For more information go to xxx.X00Xxxxxxxx.xx.xxx.
Clear and Reasonable Warnings. Commencing on or before the Effective Date, C&D shall provide clear and reasonable warnings for all Products provided for sale to customers in California in accordance with this Section and/or Title 27 California Code of Regulations § 25600, et seq., as amended from time to time. Each warning shall be prominently placed with such conspicuousness as compared with other words, statements, designs, or devices as to render it likely to be read and understood by an ordinary individual under customary conditions before purchase or use and shall be provided in a manner such that it is clearly associated with the specific Products to which the warning applies.
Clear and Reasonable Warnings. Coda agrees that as of the Effective Date and continuing thereafter, all Products it sells and/or distributes in California (except for those Products already in the stream of commerce, as provided in Section 2.3, below) which do not qualify as Reformulated Products, will bear a clear and reasonable warning pursuant to this Section. Coda further agrees that the warning will be prominently placed with such conspicuousness when compared with other words, statements, designs or devices as to render it likely to be read and understood by an ordinary individual under customary conditions of use. For purposes of this Settlement Agreement, a clear and reasonable warning for the Product shall consist of a warning affixed to the packaging, label, tag, or directly to a Product sold in California and containing one of the following statements: WARNING: This product contains DEHP, a chemical known to the State of California to cause birth defects or other reproductive harm. Or WARNING: This product contains chemicals known to the State of California to cause cancer and birth defects (and other reproductive harm).
Clear and Reasonable Warnings. As of the Effective Date, all Products Big Lots sells and/or distributes for sale in California that do not qualify as Reformulated Products shall bear a clear and reasonable warning pursuant to this Section. Big Lots further agrees that the warning shall be prominently placed with such conspicuousness when compared with other words, statements, designs or devices as to render it likely to be read and understood by an ordinary individual under customary conditions of use. A warning affixed directly to the product or product packaging, label or tag, for Products sold in California that contains one of the following statements shall constitute a clear and reasonable warning for purposes of this Settlement Agreement: WARNING: Reproductive Harm- xxx.X00Xxxxxxxx.xx.xxx OR WARNING: This product can expose you to chemicals including lead, which are known to the State of California to cause birth defects and other reproductive harm. For more information go to xxx.X00Xxxxxxxx.xx.xxx. The above warning statements shall also include a symbol consisting of a black exclamation point in a yellow equilateral triangle with a bold black outline. Where the label is not printed using the color yellow, the symbol may be printed in black and white. The symbol shall be placed to the left of the text of the warning, in a size no smaller than the height of the word “WARNING.”

Clear and Reasonable Warnings. As of the Effective Date, Xxxxxxx, agrees to provide a clear and reasonable Proposition 65 warning on the Products to comply with Proposition 65 warning regulations, including Cal. Code Regs. tit. 27, § 25600 et seq. This warning requirement shall only be required for Products that are manufactured, distributed, marketed, imported, sold, shipped for sale or offered for sale to consumers by Dongwon in the State of California.
