For the avoidance of doubt, any inability to pay an amount due and owing under the Agreement shall not constitute circumstances beyond that party’s reasonable control and “Circumstances Beyond Our Control” shall have the same meaning except that the reference to “your and our” or “us or you” in this definition shall be replaced with “our” and “us” respectively;
