Changed Circumstances definition

Changed Circumstances means changes in circumstances affecting a Covered Species or the geographic area covered by the HCP/NCCP that can reasonably be anticipated by the Parties and that can reasonably be planned for in the HCP/NCCP. Changed Circumstances and planned responses to Changed Circumstances are more particularly defined in Section 12.2 of the IA and Chapter 10.2.1 of the HCP/NCCP. Changed Circumstances do not include Unforeseen Circumstances.
Changed Circumstances means changes in circumstances affecting a Covered Species or the geographic area covered by the HCP that can reasonably be anticipated by the Parties and that can reasonably be planned for in the HCP (e.g. the listing of a new species, or a fire or other natural catastrophic event in areas prone to such event.) Changed Circumstances and the planned responses to those circumstances are described in section 6.6 of the HCP. Changed Circumstances are not Unforeseen Circumstances.
Changed Circumstances means changes in circumstances affecting a Covered Species or the geographic area covered by the SCVHP that can reasonably be anticipated by the Parties and that can reasonably be planned for in the SCVHP. Changed Circumstances and planned responses to Changed Circumstances are more particularly defined in Sections 3.7, 11.3, and 11.3.1 of the IA and in Chapter 10.2.1 and Exhibit A of the SCVHP. Changed Circumstances do not include Unforeseen Circumstances.

Examples of Changed Circumstances in a sentence

  • Of Changed Circumstances Changed Circumstances, as described in 50 Code of Federal Regulations section 17.22(b)(5)(i), are adequately addressed in Chapter 7 and Chapter 10 of the HCP/NCCP, and PSE shall implement any measures for such circumstances as called for in the HCP/NCCP, as described in Section 12.2 of the IA.

  • If additional conservation and mitigation measures are deemed necessary to respond to Changed Circumstances and such measures are provided for in the MSHCP, NiSource will be required to implement the measures in the MSHCP.

More Definitions of Changed Circumstances

Changed Circumstances means movements in the relevant insurance liability market that are beyond the control of Evoenergy, where those movements mean that it is no longer possible for Evoenergy to take out an insurance policy or set of insurance policies at all or on reasonable commercial terms that include some or all of the costs referred to in paragraph 2 above within the scope of that insurance policy or set of insurance policies.
Changed Circumstances as used in this Section 10 means (a) a reduction in Employee's base salary and benefits or (b) a material reduction in the scope of Employee's authority and/or responsibilities. In the event the employment relationship is terminated by the Company without cause or by Employee for Changed Circumstances during the term hereof, the Company shall pay Employee all accrued benefits and unreimbursed expenses owed to Employee that have accrued but have not been paid as of the date of termination. The Company shall also continue to pay to Employee all salary and benefits hereunder until the expiration of the term set forth in Section 6. Such payments shall be made in accordance with Employee's regular salary schedule. Payment of the severance benefits set forth herein shall be subject to the execution and delivery of a Separation Agreement (including a release of all claims against the Company) the terms of which will reasonably be determined by the parties. The Company's obligations pursuant to this Section 10 shall terminate immediately upon any violation of Section 3 or 4 hereof or the taking of any other action by Employee that would have the effect of declaring the provisions of Section 3 or 4 hereof not enforceable.
Changed Circumstances means changes in circumstances affecting a species or geographic area covered by a conservation plan or agreement that can reasonably be anticipated by plan or agreement developers and the Service and that can be planned for (e.g., the listing of new species, or a fire or other natural catastrophic event in areas prone to such events)” 50 CFR 17.3. “Unforeseen circumstances means changes in circumstances affecting a species or geographic area covered by a conservation plan or agreement that could not reasonably have been anticipated by plan or agreement developers and the Service [USFWS] at the time of the conservation plan's or agreement's negotiation and development, and that result in a substantial and adverse change in the status of the covered species” 50 CFR 17.3. In the event of changed and unforeseen circumstances the UDWR and the Service are committed to working with the participating property owners to implement measures that limit the level of authorized take of least chub and allow the participating property owner to continue to implement their site-specific plan in compliance with this CCAA and the Permit.
Changed Circumstances means any material facts or circumstances that arise after the Effective Date or that otherwise first become known to the Administrative Agent after the Effective Date.
Changed Circumstances means, pursuant to 50 C.F.R. § 17.3, changes in circumstances affecting a Take Species or the Covered Lands that can reasonably be anticipated by NiSource and the Service and that can be planned for. Changed Circumstances and planned responses to Changed Circumstances are identified in Section 11.2 of this Agreement and Chapter 10 of the MSHCP.
Changed Circumstances means (i) breach hereof by the Company of its obligations under this Agreement not remedied within thirty (30) days’ written notice by the Executive to the Company; (ii) subject to the Company’s right to terminate the Executive’s employment pursuant to subsections (c) and (d) above, a material diminution in the Executive’s authority or title within the Company by reason of actions taken by or under the authority of the Board, (iii) a “Change in Control” as defined in Section 6 hereof or (iv) relocation of Executive’s principal place of employment by more than forty (40) miles following the establishment of the Company’s principal executive office as set forth in Section 3(d)’.
Changed Circumstances means changes in circumstances affecting a Covered Species or the geographic area covered by the SLCHCP that can reasonably be anticipated by the Parties to the SLCHCP and that can reasonably be planned for in the SLCHCP. Changed circumstances and the remedial responses to those circumstances are described in Section 8.3.1 of the SLCHCP. Changed circumstances are not unforeseen circumstances.
