The obligations of the Contractor under this Subparagraph 4 shall not extend to the liability of the Architect, the Architect’s agents or employees arising out of (1) the preparation or approval of Maps, Drawings, Opinions, Reports, Surveys, Change Orders, Designs or Specifications, or (2) the giving of or the failure to give directions or instructions by the Architect, the Architect’s agents or employees providing such giving or failure to give are the primary cause of the injury or damage.
The Contract Sum may only be adjusted for Change Orders approved in accordance with the requirements of the Contract Documents.
Contract administration responsibilities include the preparation of Change Orders documentation (initial Change Order evaluation and cost estimating, schedule impact analysis), as well as the review and recommendation of such Work, claims avoidance tasks, coordination and permanence of shop drawings reviews, prompt responses to Requests-for-Information (RFI’s) and, the timely and safe completion of the Project within schedule.
