CDS Counterparty definition

CDS Counterparty means a counterparty that enters into a CDS Transaction with the Borrower.
CDS Counterparty means CALYON, in its capacity as protection buyer under the CDS Confirmation, unless specified otherwise in the Applicable Supplement; and
CDS Counterparty. ’ means Barclays Bank PLC in its capacity as swap counterparty under the Credit Default Swap Agreement.

  • The Portfolio CDS Counterparty shall not be obliged under the provisions of the Portfolio CDS to make available any such additional funds to the Issuer.

  • The Issuer shall only be obliged to make any additional payments to the Noteholders in respect of such withholding or deduction to the extent that the Portfolio CDS Counterparty makes available any additional funds in accordance with the provisions of the Portfolio CDS.

  • The Issuer and the Trustee, therefore, will have rights solely against the Portfolio CDS Counterparty in accordance with the Portfolio CDS and will have no recourse against any Reference Entity or to any obligation of any Reference Entity.

  • Although the Portfolio CDS Counterparty and/or its affiliates may have entered into and may from time to time enter into business transactions with Reference Entities, the Portfolio CDS Counterparty and/or its affiliates at any time may or may not hold obligations of or have any business relationship with any particular Reference Entity.

  • Upon an early termination of the CDS Contract, the Issuer may, except in certain circumstances, be required to make a termination payment to the CDS Counterparty.


More Definitions of CDS Counterparty

CDS Counterparty means a counterparty to one or more credit default swaps with the Bank in which the Company is a “Reference Entity”, as defined in the ISDA Credit Derivatives Definitions, and where the aggregate notional amount of such credit default swap(s) is at least $10,000,000. For the avoidance of doubt, if a central clearing entity recognized by a U.S. federal regulatory authority is a counterparty to one or more such credit default swaps, such central clearing entity will also be a “CDS Counterparty”.
CDS Counterparty means a counterparty to one or more credit default swaps with the Bank in which the Company is a "Reference Entity", as defined in the ISDA Credit Derivatives Definitions, and where the aggregate notional amount of such credit default swap(s) is at least $10,000,000. CDS Counterparty. Entity Type", "Interest Rate Swap", "IRS Counterparty", "Reference Entity", "Reference Entity Notional Amount", "Reference Obligations", "Settlement Method" will have the meanings given to them in the Drawdown Deed entered into in connection with a particular Series. Certain elections for the purposes of and/or variations to these Credit Linked Provisions are set out in the Additional Conditions of such Credit Linked Notes under the heading "Credit Linked Notes", and are referred to in these Credit Linked Provisions as "Additional Credit Terms". If there is any inconsistency between the Base Conditions, these Credit Linked Provisions and the Additional Conditions of the Credit Linked Notes (including the Additional Credit Terms), then the following documents will prevail in the following order of priority:
CDS Counterparty and “IRS Counterparty” shall mean CALYON, in its capacity as protection buyer under the CDS Contract and counterparty under the IRS Contract (if any), respectively, unless specified otherwise in the Applicable Supplement;
CDS Counterparty means Morgan Stanley Capital Services Inc. or any other Affiliate of the Issuer selected by the Determination Agent.
CDS Counterparty. ’ means The Royal Bank of Scotland plc in its capacity as swap counterparty under the Credit Default Swap Agreement.
CDS Counterparty means a Portfolio CDS Counterparty and/or a Single Name CDS Counterparty.
