CCAA Plan definition

CCAA Plan means the Canadian Debtors’ plan of reorganization and compromise pursuant to the provisions of the CCAA and Section 191 of the CBCA, as it may be amended, varied, or supplemented by the Company from time to time in accordance with its terms, that was filed on May 4, 2010, as amended on May 24, 2010.

CCAA Plan shall have the meaning set forth in Section 9.18 hereof.

CCAA Plan means a plan of compromise and arrangement proposed or filed with the Canadian Court in the CCAA Proceedings, as approved by the Canadian Court.

• All capitalized terms used but not defined herein shall have the meanings given to such terms in the CCAA Plan.

• If the undersigned does not deliver a valid Distribution Election Notice prior to the Distribution Election Deadline, or this Distribution Election Notice does not indicate a Distribution Election, or more than one Distribution Election is recorded, the undersigned will be deemed to have made the 75% Distribution Election and shall be required to attend at the Creditors’ Meeting of the General Unsecured Creditor Class to cast its vote on the CCAA Plan.

• The undersigned acknowledges that if the undersigned selects Convenience Class Distribution Election, the undersigned will be deemed to vote in favour of the CCAA Plan.

• Class 8 Claims shall be satisfied solely in accordance with the terms of the CCAA Plan, and shall take nothing in addition thereto under this Plan.

• All questions as to the interpretation or application of the Consolidated CCAA Plan and all proceedings taken in connection with the Consolidated CCAA Plan and its provisions shall be subject to the exclusive jurisdiction of the CCAA Court.

More Definitions of CCAA Plan

CCAA Plan means the Fourth Amended and Restated Plan of Compromise and Arrangement dated February 15, 2000 of PetroKazakhstan and PKOSI under the CCAA, as supplemented or amended from time to time;

CCAA Plan means the plan to reorganize pursuant to the second amended and restated plan of reorganization and compromise of the Company and certain of its Subsidiaries dated November 1, 2010 which has been filed with the Canadian Bankruptcy Court and as may be further amended, supplemented or otherwise modified from time to time.

CCAA Plan means this plan of reorganization and compromise jointly filed by the Applicants pursuant to the provisions of the CCAA, Section 191 of the CBCA and such other Sections and legislation to be set forth in the Restructuring Transactions Notice, as it may be modified, amended, varied or supplemented by the Applicants from time to time in accordance with its terms, including by the Restructuring Transactions Notice and any CCAA Plan Supplement;

CCAA Plan means the further amended plan of compromise and/or arrangement in connection with the proceedings under the Companies’ Creditors Arrangement Act, R.S.C. 1985, c. C-36, initiated by Plus Products Inc., as may be amended and restated from time to time, substantially in the form attached as Schedule “A” to the Acquisition Agreement.

CCAA Plan means the plan of compromise and/ or arrangement, as may be amended and restated from time to time, on terms acceptable to the Parties and the Monitor and substantially in the form attached hereto as Schedule “A”.

CCAA Plan means the Amended Plan of Compromise and Arrangement filed by MMA Canada in the CCAA Case and which CCAA Plan, inter alia, shall contain Releases and Injunctions for the benefit of Released Parties, a copy of the CCAA Plan is attached to this Plan as Exhibit 1.
