Case Professionals definition

Case Professionals means Borrower’s and any Statutory Committee’s professionals, retained by either of them by final order of the Bankruptcy Court (which order has not been reversed, vacated or stayed unless such stay is no longer effective) under Sections 327 or 1103(a) of the Bankruptcy Code.
Case Professionals means Persons or firms retained by the Loan Parties or the Creditors’ Committee or other statutory committee appointed in the Chapter 11 Case pursuant to §§327 and 1103 of the Bankruptcy Code.
Case Professionals means any professional hired by the Debtors, the Committee or otherwise who seek to be paid by the Debtors for services rendered in relation to this case.

Examples of Case Professionals in a sentence

  • Nothing herein shall constitute a waiver of any right of the Bond Trustee to object to fees and expenses of Case Professionals.

  • Nothing herein shall be construed as a consent to the allowance of any professional fees or expenses of any Case Professionals or shall affect the right of the DIP Agent or any of the DIP Lenders to object to the allowance and payment of such fees and expenses.

  • Any amount of the Case Professionals’ Carve Out remaining after the payment in full of all Allowed Professional Fees of Case Professionals pursuant to final fee applications and orders in the Cases shall be returned to the DIP Agent, which amounts shall be applied to the Obligations in the order and manner required by the DIP Loan Documents.

  • Nothing herein, including the inclusion of line items in the Budget or the Carve Out Budget for Case Professionals, shall be construed as consent to the allowance of any professional fees or expenses of the Debtors or of any person, or shall affect the right of the DIP Lender to object to the allowance and payment of such fees and expenses or to permit the Debtors to pay any such amounts not set forth in the Budget or in excess of the Carve Out Budget.

  • Other than (i) the DIP Liens and (ii) the Carve-Out and the claims of any Case Professionals payable from the Professional Fee Escrow, the Adequate Protection Liens shall be senior to any lien or security interest heretofore or hereinafter granted in the Chapter 11 Cases or any Successor Cases.

Case Professionals means any professional (other than an ordinary course professional) retained by the Borrowers or the Committee pursuant to a final order of the Bankruptcy Court (which order has not been vacated or stayed, unless the stay has been vacated) under sections 327, 328, 363 or 1103(a) of the Bankruptcy Code.
Case Professionals means professionals retained, with the approval of the bankruptcy court, by the Borrowers and any Committee.

Case Professionals means any and all of the professionals formally retained by the Debtor or any committee of creditors appointed in the Case, as such professionals’ employment is formally approved under a final order entered by the Bankruptcy Court in the Case pursuant to Sections 327 and 1103, as applicable, of the Bankruptcy Code. This term “Case Professionals” does not include any financial advisor employed by any committee of creditors or equity holders appointed in this Bankruptcy Case.
Case Professionals means (a) any and all of the professionals formally retained by the WV-Debtors; (b) any professionals formally retained by the official committee of unsecured creditors appointed in the Bankruptcy Cases, (c) a patient care ombudsman, if any, if appointed in the Bankruptcy Cases and (d) any professionals formally retained by the patient care ombudsman (if any), in each such instance, provided such professionals’ employment or appointment is formally approved under a final order entered by the Bankruptcy Court in the Bankruptcy Cases pursuant to Sections 327, 333 or 1103, as applicable, of the Bankruptcy Code.
Case Professionals means persons retained and/or to be compensated pursuant to sections 326, 327, 328, 330, 503(b) and 1103 of the Bankruptcy Code during the Bankruptcy Cases to perform professional services.
